New starters and commit to deliver

Post by olilew »

Is it true new starters have commit to deliver in their contract? We have a new guy started a couple of weeks ago and he says it's in his contract that he has to stay out and complete his delivery no matter what. He was unaware of this when he started until he got his contract. He is probably going to leave very soon. Already disillusioned with the job. If it is true how do RM think they're going to recruit with these terms and conditions? Especially with minimum wage rising next year!

It can't possibly be in their contract.

Commit to deliver means compulsory overtime, which is illegal.

He's probably been lied to by a manager and / or is confused about what willful delay actually means.

I saw three new starters yesterday going out with a York of packets at 6pm. Started at 8.30am.
I told them not to deliver if the driveway is too dark or it’s secluded land. The risks are too high.

Compulsory overtime is NOT illegal if it is in the contract

What happened to take everything out and see how you get on? You must be able to tell the manager what you’re able to do in your time otherwise they’ll just try and lump 20 bags of double mail on you.

They finished one of the agency lads at our place because he wouldn't work past his time to finish off the delivery. It would have meant that he would have been working till gone 6pm and he wasn't prepared to do that everyday

At the very worst, they have to stay out and deliver... until they find something else in a week or so.

Only if they haven't opted out of the Working Time Directive (or whatever it's called in UK law)

We have new starters who have this in their contract. Out of 7 new starters 2 weeks ago, 5 have left already and one has a job offer to start in two weeks time.

The question wasn't about working over 48 hours, it was about whether overtime could be compulsory! :arrrghhh

As spacephoenix has stated, individuals can opt out of the 48 hour rule as well - and that information is also in the link I posted! And 48 hours in a 5 day week is just over 9.5 hours a day, so plenty of scope for compulsory overtime without going over 48 hours anyway.

I was referring to the fact that it can be compulsory if it’s in a contract, but not if you opt out of the 48 hour week

Yet they still wonder why they can’t get people to stay when even the experienced guys on the old contracts have had enough! Soon there will be no on left to work at the Royal Mail and you’ll have the likes of Ricky Macauley & Co turn up on your doorstep at 6pm in the pissing rain at 6pm on Xmas eve.
