Do they take months out youve been off sick out of the ill health?

There are no ' no win no fee' lawyers who will take a case on of delaying or mismanaging the implementation of IHR. There isn't enough money in any final compensation that would cover the proportion they need to take to cover their fees.

HR have no legal authority to delay implementation or delay seeking medical opinion in any case which might be suitable for IHR. Take no notice of any form of management Comms that say otherwise. If you qualify after your Optima opinion states your unfit then it should also be processed immediately.

You could resign and claim constructive dismissal. You could take the new reduced IHR under protest and sue for the better IHR terms after you've left.

However I would strongly advise you seek legal advice before making your moves as it's easy to leave too soon or miss a tiny trick and blow your constructive dismissal claim or claim for contractural enforcement of the old IHR terms.

The legal guys/gals who know their stuff cost £250 an hour but you might find one who can give you an hour's free advice. Be prepared to ring about 10 employment solicitors before you find a diamond with a kind heart prepared to do this.

If it were me, I'd be hoping the legal advice was that if I had the Optima opinion on IHR prior to agreement and HR failed to implement , I would have a case for enforcement of the older better terms. I think I'd have to put in writing that I was accepting the new IHR given under protest and then immediately lodge a claim.

For those without the evidence from Optima before say mid July , it's going to be harder to mount a claim. You need to be aggressive with HR . Not verbally aggressive, I mean politely assertive. For those who instead wait patiently for HR to act lawfully and enforce the agreements, the Tribunal just tend to take that as acceptance.

i get your point, i do, some people do take the preverbial and the genuine ones get screwed

however RM imo are encouraging people to do this with the way they have done this, now 1 day sickies are pointless, most will just stay off for a minimum 1 week now

it is a bit childish however, blaming everything on the YES voters

i thought under the new agreement that NO months are deducted from either your lump sum or pilon if off on the sick

there was 2 proposals, keep at 34 weeks but deduct sick weeks, or change to 16 weeks with NO deductions for sick

can someone confirm this either way which one it is please

Yes, 16 weeks is the minimum, then you add on PILON and any untaken leave.

The company had an earlier proposal to reduce ihr payments by one week for every week taken off sick.

I'd say about a third of our DO (and it's a big one) has been signed off this week with various ailments. The place is an utter shambles that was understaffed anyway.
Maybe less people would go "sick" if the holiday system wasn't so convoluted. You can't get 2 consecutive weeks off where I am, and the week off I've booked (leaving Sunday) has been ruined by the sudden revelation from management that I'm working Sunday ("you should have thought of that before you booked the holiday, technically Sunday is part of the week you haven't booked off," was the response from the rep.)
The sooner this company collapses the better

My real point is there is people out there with genuine mental health problems (had them myself a while ago).yet this guy is citing the yes vote as a mental health reason :shock:
