If the result of the ballot is a no then we do have rights

By law we can refuse to work the new start/finish times should Royal Mail attempt to impose them without agreement

I have sent the information that I’m sharing with you below to my area union representative and he is discussing it with the unions solicitor on Monday so we can fully understand the implementations and risks involved with this course of action

Let’s make an informed decision based on the facts

This will have a much bigger impact if done nationally rather than locally so I’m asking that you could do the same and ask your union reps to contact the unions legal advisers regarding this so we can fully explore this option and look towards our next steps should the ballot return a no vote

You are f****d if your contract states that the hours may change depending on the needs of the company like some of the contracts have had over the last few years. You've literally signed on the dotted line. If it's stated what your start times and finish times are, you are in the clear.

I've voted NO ,there is lots in this agreement that could be in breach of contract,why the hell the union have tried to sign us up to this i'll never know,maybe they don't want to spend our subs on legal fees and instead on their inflated wages,it doesn't have to be their way VOTE NO !!!!!!!!

to right , so does seasonal hours also fall in to a breach of contract as most f/t are on a 37 hr week , and not a 39 hr or a 35 hr which they are trying to get through .

Don't you think that since the change in start times is probably the most controversial part of the agreement if the union believed for one minute that the entire membership could simply refuse any enforced change it would even have been part of the deal?

If that were the case the union could have demanded anything they wanted in return for that concession.

Don't you think if it were that simple most of us would still be starting at 0500 and finishing before 1200?

If they move the work later which they are perfectly entitled to do what are you going to do at your original start time?

Yeah I don’t know how the new contracts are worded but if you’ve been doing the same hours for a long period of time it can be argued that that is your contract with regards to working hours

This is why we need to talk with the legal advisors

Here’s the bit about variation or flexibility clauses:

My contract has a variation or flexibility clause
If there is a term in your contract which allows your employer to change your terms without your agreement, sometimes called a “variation clause”, this only is generally allowed to be used for reasonable changes of a minor and non-detrimental nature.

Once road traffic is factored in, the DOs furthest from us probably don't get their wave 2 work arrive until around 08:00ish. For MCs that cover a much larger geographical area it'll be even later that the DOs get their wave 2 and that's before the axing of many Skynet flights
