No they can't. British Gas and Tesco ended in fire / rehire, agreement, courts, or all of the above.

Court of Appeal overturns injunction in Tesco v Usdaw

But agree they would need previous agreement so error on my part

This means any wrongful dismissal would cause financial restitution in the civil courts but would not prevent the employer from taking the actions they felt were necessary for the future success of their business.

Then we have British Gas

It is a legal minefield, but I believe Martin indicated before, that the union has legal power, via collective bargaining, to bring about contractual change if necessary to prevent loss of jobs or possible insolvency. They are working to defend employees, and even if said employees want to sink the company they work for, they have legal precedent to protect them from this.

They won't need to prevent a loss of jobs as it is happening already.

The company targeted a reduction of 5,000 Full time equivalents by the end of March and in fact delivered around a 10,000 reduction on exit from the year earlier. The company's rightsizing which is part of its 5 point stabilisation plan from November last year is well on track, apparently due to the revisions...

Didn't Tesco forecast profits of £2.5 billion for 2021? They ended up giving workers a 5.5% pay increase backdated if I remember and it's only because this topic has cropped up before

Yeah, I should have been clearer. I meant all of our jobs. No union is going to act in a way that directly leads to the company of the employees they represent, going under. It is why this deal is, frankly, s**t, because it is the only way for them to reach agreement, ensure a rise in wages, and keep union members employed.

It is also my theory as to why the vote has been delayed. If there is any possibility of a no-vote they will not send out ballot papers. It is also my presumption as to why there have been rumours of an increase in the proposed lump sum. They have to get this deal over the line, for our sakes and theirs.
