And, there we go. Very next redlen post ignores all these brilliantly articulated counter points, and moves onto a different avenue, as if none of this has been said or happened. Actively encouraging employees to withdraw their labour on a specific day when no statutory immunity is in place breaching their contract of employment. Therefore, subject to the disciplinary process for abandonment of duty.
Breach of contract is a civil matter. It’s not illegal so the CWU aren’t encouraging you do something illegal.
They are asking you to breach your contract exactly the same way they did on strike day 1.
The only thing that changes is that before today RM wouldn’t be able to dismiss you (for this reason) as your breach of contract was protected because you had a lawful/legal ballot.
From today you still have a lawful/legal ballot but the protections from any actions -including dismissal- cease.
If you continue IA beyond 6 months of ballot then that IA becomes unlawful. If they encouraged then, that would be inciting you to do something unlawful.

Well there were and are two ballots so in answer you are not in breach of your terms here:https://www.theguardian.com/business/20 ... ispute-cwu 19/07/2022
And the 12 week thing is just a fantasy they cannot get postmen in certain parts of the county and would have to apply it to all workers even non union people and even acting managers.
So there you have it in black and white have a great Christmas and a happy new year everyone!
