Re: CWU : The 12 week sacking thing if on strike.
You'd think if this final day of strike was illegal the RM executives would have been all over it in their public war of words with the Union.
The idea that its a trap to sack 1000s avoiding redundancy pay is both fallacious and specious. It would be straight to an Employment Tribunal because employer would be obliged to warn the employee that it was a sackable offence.
There was no such warning.

Nobody has said anything about dismissing or the strike date being illegal, that was never going to happen and a destraction from the real issue.
Actively encouraging employees to withdraw their labour on a specific day when no statutory immunity is in place breaching their contract of employment. Therefore, subject to the disciplinary process for abandonment of duty.

Again.....from ACAS website:
Unauthorised absence
The employer should try to contact the absent employee as soon as possible, including using any emergency contact they have.
Almost 1pm and no phone call from manager...
We are good.

AD, I honestly don't know how you've the energy, mate. The bloke is exhausting, it's literally the same paragraphs endlessly recycled from him. He says something, posters counter it, he copies and pastes a quote from a website, posters counter it, he moves along to a slightly different avenue, claiming he's said nothing of the sort, it gets countered, he ignores it then goes back to the start. Honestly, if you were to delete his duplicate posts, there'd be none.Acca Dacca wrote: ↑24 Dec 2022, 12:27So we all must have got a phone call asking where we are then right?redlen wrote: ↑24 Dec 2022, 12:08Nobody has said anything about dismissing or the strike date being illegal, that was never going to happen and a destraction from the real issue.

The first day you strike, you’re in breach of contract, but the law protects you, for 12 weeks.redlen wrote: ↑24 Dec 2022, 12:08Nobody has said anything about dismissing or the strike date being illegal, that was never going to happen and a destraction from the real issue.

Breach of contract is a civil matter. It’s not illegal so the CWU aren’t encouraging you do something illegal.
They are asking you to breach your contract exactly the same way they did on strike day 1.
The only thing that changes is that before today RM wouldn’t be able to dismiss you (for this reason) as your breach of contract was protected because you had a lawful/legal ballot.
From today you still have a lawful/legal ballot but the protections from any actions -including dismissal- cease.
If you continue IA beyond 6 months of ballot then that IA becomes unlawful. If they encouraged then, that would be inciting you to do something unlawful.

The only way that peoples' futures are on the line is if Thompson is allowed to make the changes to this job that he wants.
People have been on strike today. If, when we return after Christmas, every single one of us is notified that we are all facing disciplinaries for gross misconduct then you can come back on here and say "told you so". If, on the other hand, that doesn't happen then you can come on here and apologise for the complete and utter bollocks that you have been spouting on this subject.
Presuming that you were also on strike today then I wish you a very merry christmas and hope that it gives you time to reflect on your outrageous behaviour, trolling and scaremongering on this forum when people are making a stand and fighting for the future of Royal Mail.

This post is largely immaterial now - many chose to remain on strike today, including me; if there are consequences because of that, so be it, if not, even better ...

Constructive dismissal it is then for most of us all.guardianangel wrote: ↑24 Dec 2022, 09:32im sorry to burst your bubble but by law if they give you 90 days notice they can change your contract and you sign or leave no redundancy.k979aaa wrote: ↑23 Dec 2022, 19:05Thing is I have a contract I will not be Signing a new one they can make me redundant or IHR simple asguardianangel wrote: ↑23 Dec 2022, 18:15They were always going to do that anyway ,when you sign the new one it doesn't stop us striking ,we carry on if we are going down lets take them with us or lets make it as hard for them to make any money .LouBarlow wrote: ↑23 Dec 2022, 08:56They won’t sack people but it gives them the perfect opportunity to tear up our current contracts and offer us new ones or the door i.e. the CEO’s goal from the start. It is a massive own goal.guardianangel wrote: ↑23 Dec 2022, 08:30Dont worry id like to see them sack over 100000 posties ,i can assure you they won't find 100000 agencies workers to stick at this job to long ,that's even if they can find that many workers in the UK at the moment.
