Re: CWU : The 12 week sacking thing if on strike.
Royal Mail would have to shut down the whole postal service for about 2 months if they decided to sack all 115 thousand postal workers.
They would have recruit , train and up skill an entire new work force and in this Labour market where are you going to get all the new network drivers.
Royal Mail would have to risk the company’s future by doing such an unpopular P and O style tactic.
Why would they do this ? They also decided to close the majority of delivery offices for the first number of strikes so never allowed individuals to go to work.
In addition there have been talks and yesterday RM requested further talks in early January to conclude an agreement. Hardly the sign of a company lining up to sack 115 thousand workers

I'm still striking, I dont think he will sack us all but he will do something, I dont know what but he will retaliate, so watch out for what is coming, oh and don't expect this Tory government will give a Shiite about us as they just look after all their mates, wouldn't trust anyone of them, especially not Thompson

In all fairness this is nothing about the possible dismissal of 115,000 workers. That was never an option. The internal conduct procedure will take care of that for any breach of contract.
The Issue is the CWU actively encouraging employees to break the law and put themselves into a position of contravening that conduct code.
That is Maleficence in office for which anybody posting such advice on an online platform as encouragement to break the law such as social media can be subject to criminal action, as well as the Trade Union they represent being sanctioned by the relevant authorities.

You can’t get it into your head that there is a difference between it being a legal strike without legal protection and illegal actredlen wrote: ↑24 Dec 2022, 07:29Martin Walsh wrote: ↑24 Dec 2022, 07:13Royal Mail would have to shut down the whole postal service for about 2 months if they decided to sack all 115 thousand postal workers.

The ballot is what makes it legal and the ballot is still live

Encouraging a third party to commit an illegal act , as in breaking the law on an online platform is an illegal act punishable by criminal sanctions.

Re: CWU : The 12 week sacking thing if on strike.
There is no illegal act
The ballot result is still live
The legal protection is what no longer applies
That doesn’t make striking illegal
Stop talking about stuff you don’t know anything about clearly
If the union were calling for strikes after 6 month without reballoting then it wouldn’t be a legal strike and RM would have it stopped via court order
Like I’ve told you a million times - that’s a different issue than the 12 week legal protection issue
If you tolerate this, then your paid break will be next

Re: CWU : The 12 week sacking thing if on strike.
Will try and let this sink in for the third time?
This has nothing to do with the dispute or ballot
Encouraging people to commit an illegal/unlawful act on social media is a criminal/civil transgression punishable under legislation.
Advising employees to strike when the legal protections have ended is contrary to law, as in incitement with industrial unrest. (agent provocateur) Many are under suspension at this very moment for alleged misconduct on the picket line.
That law being the Trade Union Labour Relations Consolidation Act 1992
Not to mention contrary to civil law with advising employees to breach their contract of employment.
The CWU can be held liable for any finacial loss Royal Mail has been subjected as a consequence of that breach.

Re: CWU : The 12 week sacking thing if on strike.
Unauthorised absence:
Unauthorised absence is when someone does not come to work and gives no reason for their absence or does not contact their employer.
Other terms people might use include:
‘AWOL’ or absent without leave absent without permission
The employer should try to contact the absent employee as soon as possible, including using any emergency contact they have.
If contact cannot be made, the employer should discuss the absence with the employee when they come back to work.
If the employee cannot provide good reason for the absence and lack of contact, the employer might consider further investigations for possible disciplinary action.
Well, if this is a day that they are expecting us in due to this '12 week thing'....then the employer is supposed to try to contact you if you don't phone in. I will just remain by my phone and see if a manager calls. If they don't call then they obviously aren't expecting us in and have accepted it's a strike day and aren't looking to go down the disciplinary route. Royal Mail themselves have not put out any warnings about not turning up today - no communications about risk to your job or disciplinary action.
Anyone can say they were sick or have an injury. As far as I am aware they still aren't paying sick pay on strike days so that's an excuse for not phoning in.
Has anyone got a phone call yet from their line manager? or has any line manager simply stepped outside their building onto the picket line telling picketers that they should be working as they haven't phoned in sick?

But why risk your very employment in the first place without official confIrmation from either your employer or the CWU?

The ballot is still live
After 12 weeks employees don’t have legal protection from dismissal ( provided the business conducts these dismissals correctly which as explained includes dismissing practically every single employee ) but that doesn’t mean the 6 month mandate from a ballot result becomes null and void which you seem to miss out
It is a legal strike and any strike up until 17th February will be legal on the change ballot
Just unprotected
Now stop spreading scaremongering disinformation

For the last time
Nobody said the balloted strike action was illegal, for a second time, not illegal
Encouraging someone to commit a Civil/Criminal transgression on social media is, and punishable by both civil and criminal sanctions.
With plagiarising Thomas Paine:
To argue with a man who has renounced the use and authority of reason, is like administering medicine to the dead.

The only thing that’s being encouraged to do is to continue the strike action
Which you’ve just said is not illegal
