So do we strike and hope RM don't issue everyone with new contracts on lower hourly rates and all the other changes they want take or leave it, or cross the picket line for one day so they can't do it to those that have worked? We go in take full breaks, no running, cutting corners and finish on time??. I feel RM are giving us a rope and we are about to hang ourselves and I'm concerned like many others of the repercussions. Why the hell did CWU choose 24th as a strike day knowing what it would mean

The legislation in place does allow after a 12 week period of Industrial Action for an employer to dismiss however that is also dependent upon discussions/talks and attempts to resolve the dispute during this period taking place.

I don’t think that this post helps much.
It’s been a known concern for a while and now we are told by the CWU that we CAN be dismissed after 12 weeks although it’s unlikely.
We are used to the Royal Mail legal team pulling rabbits out of the hat so confirmation that the CWU legal team have covered all bases would be more helpful.

The above post says that if used RMG would have to dismiss all circa 128000 employees. Is that number the amount of staff expected to be striking on the 24th ?

Because the CWU should have balloted six weeks ago so the protections continue after Christmas.

My guess is that they thought it would be all over by Christmas and were trying to save money.

Ballots are expensive

The Union keep telling us to stay strong and we will win this, hands up if you think that's the case? The majority in my office, as solid as it has been now think it is going to be a waste of time.

Does a new ballot mean that it’s a new strike under the 12 week rule ?

Yes, a new ballot has been called for the 16 January but, it will take six weeks to give notification on future strikes so looking at the end of February

Lawfully taking IA is technically breach of contract regardless of the 12 week issue.

It's probably also the reason calling off the next 2 strike days was turned down. Simon wants us to strike and to break the 12 week rule.

But he is acting on instructions from the CWU as a representative of that institution. In his position as an NEC/PEC member it will be expected he is aware of the legal aspects of calling a strike.

This is incitement with causing industrial unrest and the Royal Mail legal team will exploit to the max as propaganda

Honestly you can’t make this s**t up.
How long have people been putting this question to colleagues, reps and senior CWU officials?!!
Over and over again it’s been ignored until 36hrs before when they finally acknowledge it and come back with “yeah, you’ll be in breach of your contract but don’t worry , they can’t sack you all”

If it weren’t so serious I’d be pissing myself at how amateurish this lot are .
I’m a staunch striker and will stand up for what’s right but this isn’t good enough. Never should we have even been anywhere near this situation nevermind in it.

And what if Royal Mail do tear up 128,000 contracts legally on the 24th December? Then offer new ones when we return?

I’m genuinely thinking about what to do on the 24th, one thing is for sure, when we’ve had all week to strike without repercussion is that I am coming out of the union. f***ing idiots.
