Last comment from me as do not partake in a willy waving contests.

The problem is that yourself are posting on political persuasion, prejudice and allegiance to an organisation, whereas Myself, am applying the law to the facts.

I ask you again what are your qualifications in employment law ? The rules on ACAS binding arbitration as opposed to nvolvement in conciliation or advice are totally different. If it is binding then ACAS publish their decision within 21 days of the arbitration taking place and both parties must stick to it. Are you priviledged to their decision? It might be ACAS recommended a 10% pay rise with no strings! The point I make is you are only guessing the terms of reference of the arbitration. You do not know but seem to state everything as a fact not just your opinion.

I would have thought that the moment RM decided to tear up all previous agreements that they effectively proved they are not negotiating in good faith and are also undermining current negotiations because is it reasonable to try and reach a new agreement with an employer who has just torn up the old agreement?

Then again, saying that, I have little faith that the course of justice would be impartial in certain cases of employment law. Remember how our ballot during the pandemic was dismissed as being against the country's best interests.

You honestly don't think he'd be hanging that, sword of Damocles, over our heads to get us to submit to his "best and final offer". I don't see the advantage in keeping quiet about plans to dismiss a 115,000 workforce on the same day.

You cannot dismiss anybody on the same day, let alone 115000 employees.
You have to follow the disciplinary procedure or any dismissal will be unfair. That takes months in reality

So you accept it’s a complicated process that takes
months and has to go through disciplinary procedures just to fire one person

Yet here you are, arguing that it’s a realistic prospect that they go through all that for not one, but over 100,000 employees
If you tolerate this, then your paid break will be next

If Royal Mail dismisses one of us for striking, they’d have to dismiss all of us otherwise it’s unfair treatment. Even before then I think they’d bypass the union, do an Asda and hand us all a contract with a ‘sign it or leave’ ultimatum.

It’s one thing dismissing 800 workers on a ferry in the middle of the sea when your contract is registered in another country and there are security firms ready to remove you when you dock.

It’s another thing dismissing 115000 workers based in the UK. I just can’t see everyone shrugging their shoulders, saying ‘oh well it was ok while it lasted’ emptying their lockers and walking quietly away from the DO or Mail centre. There’d be huge protests, Simon and other senior figures would be at risk of physical attack, things could get violent. And then you’d have mass employment tribunals.
The day is gonna come when we’re all gonna have to testify.

100,000 unfair dismissal claims that RM would probably lose.

And 100,000 vacancies they would need to fill within days.

The company would collapse, for good, if they even tried it.

No-one listen to the anti-strike trolls on here.

I just read this on a law site;


If industrial action is protected the trade union will be immune from any action by the employer to sue them for inducing employees to breach their contracts of employment. If industrial action is not protected, even if it is official, an employer will be able to seek an interim injunction in the High Court to prevent the industrial action from taking place or damages from the trade union if the industrial action has already taken place.


Maybe this is why ST is not mentioning it.

Well, all the keyboard lawyers on here can give their "expert" views, but there are only 2 set of lawyers that matter...those of RM and the CWU.

As for saying that Thompson can't do this, can't do that, you never know what rabbit he will pull out of the hat next, he seems very quiet of late....me thinks the gun is being re-loaded.....

What about giving everyone who strikes on the 24th a two year serious?
Makes it easy for RM to pick us off one by one at a later date.
How realistic a prospect would this be?

The idea of being able to sue the union after the event and potentially bankrupt it must seem quite appealing to RM.
To not say anything beforehand, allow people to strike on the 24th then sue at a later date would achieve exactly what RM are after, a broken CWU.

I'm glad this is being spoken about here as no one at work even seems aware of it.
