Agree, the legal protections run out after 13 weeks after ACAS involvement. (23 December) You continue to strike you can be dismissed.

The only way out is a fresh ballot. But that is even to late now implementing in time new strike dates

His proposal looks trash. It looks like a pick a mix but without the sweetener. Simon has got to try better instead of waffling so much 💩.

Sticking with the union till they can actually construct a better agreement.

What about Fleet? I see we're not being included in the new proposal. What happened to we're all in it together and no-one will be left behind? I've stood strong through all the strike dates only to be sidelined with all my Fleet colleagues. If the vr deal comes my way, I'll be better off taking it than staying. Looks like we've been let down....again.

Very concerned with this 13 weeks ACAS involvement talk and being dismissed without a fresh ballot for striking. Is this going to be a big issue? Or will we just be selling them next year?

It would be a legal minefield to try and dismiss everybody, which they'd have to do. Not to mention the horrible PR that comes along with such action.

Simon Thomson has personally ruled out "fire and rehire". Probably because he knows it would blow up in his face, not that I place much stock on his word.

So while not being legally protected, you are protected in the sense if they fire you, they'd have to fire everybody.

There would also be thousands of people willing to take them to tribunal. Including myself.

There's obviously some fine legal minds on Royal Mail Chat, but I'm not sure that it is as clear cut as 12 weeks and then the dismissals start.

From what I understand, employees could claim for unfair dismissal if the employer had sacked some but not all of those taking part in industrial action after the 12 week 'protected' period.

So, they couldn't just sack a few of us to make an example, they'd have to do the whole lot of us.

Further to that, there's the question of 'has the employer taken reasonable steps to resolve the dispute?'

Some people would argue they have, but others might say that reheating what is substantially the same offer from when industrial action began, is not a serious attempt to resolve the dispute.

I don't think Royal Mail would go down this route because it could get expensive and messy for them. Tens of thousands of employment tribunals etc.

If they threatened it though, we should all be out on the picket lines and see if they're really going to sack the lot of us (and if there wouldn't be some government intervention before then).

More importantly though, the trade union movement has never made its gains in the court room. Sure, eventually some of them were enshrined in law, but workers' rights were always won on the streets, on picket lines etc. And that's where we need to be until this dispute is resolved.

Happy to carry on striking. Can’t agree to this final final offer and wont be any worse off than when they gave a load of us the chop last Christmas Eve just because we weren’t on RM’s books at the time.

If the CWU get a sniff of it, they can just re-ballot on Fire & Rehire, and restart the 12 week protected period.
