TAKE. IT. TO. ACAS.
EVERYONE, FOR GODS' SAKE.
The penny is dropping.
so the letters the cwu was sending out for people to cancel e/t claims was they just for the last 2 years or for any more claims in the futurethe agreement going forward as to be honest i had claims in and i cant remember if i slung my letter in the bin :d'oh! , so is there anyway i can find out if my claims are still going as i am no longer a union member , cheers
As I understand it, regardless of whether you have a claim in with ACAS, the period we are currently in will be paid to everyone.
You would then have to open a new claim with ACAS for this I would imagine, as if you crap out on one of months this would then mean no payment for April to September this year.
I'm not in the union so no idea what they've done/are doing with regards the previous 2 years.
What I do know is the deal they agreed is a farce.
Frankly I wouldn't trust the union to negotiate at a car boot sale.
In your case, if you dont get a payment this week, your case is probably still open and is being dealt with at Bristol Court this or maybe next month.
I'm not expecting any money for the last 2 years for a good while yet.
The current period I know for a fact I don't qualify, so will be opening another claim in November once that's confirmed, as that's when we get paid for this period.

I'm assuming you have no holiday pay at all this week?

Your case is still with ACAS then I would imagine.
Communication from them has been sketchy.
I have had 2 or 3 update emails in last 2 years.
The last one was yesterday when I got one to say my case has a preliminary hearing along with a few others this month.
As you're no longer in the union you will need a case reference number from the court.
Failing that it's just a waiting game and see if they contact you.
You could always send a question to HR via the app and ask the situation so at least you know.
Pm me and I would be happy to send you the number of someone that is really helpful who works at ACAS.

Was not made aware of any deadline date at all, 0 communication.
I’ve been campaigning for this for years, made people aware of what they needed to do.
I’m a part timer being shafted, doing full time with no contract and I come in today to find out a load of the full timers have received £1.5k in their payslips?
They never submitted a letter withdrawing their claims either. Only the full timers have got this, no part timers.

Is this another case of part timers getting f****d over? Lol

This company and the union are a joke

You have the option to submit an ET claim on the basis you have not been paid your average holiday pay. Then it opens up the whole debate about what is average and whether the 8hr set by RM is fair and reasonable. Your case makes clear it’s not. If enough people in your position issue claims, RM may well get beaten. You have 3 months to open a claim from now.

https://www.gov.uk/employment-tribunals/make-a-claim

It costs nothing and will probably be linked with the other holiday pay claims.

People are complaining about something that's been in black and white for at least 2 months.
Everyone that's unhappy, put in an ET claim.

I've been on annual leave for almost entire month. Does that mean I haven't hit requirement for that half year payment or do weeks when you're actually on holidays are excluded from calculations?
Can't really find any information about that anywhere in the agreement
You don't qualify, as you probably found out today if you have the app.

It's actually even better now that they have helpfully spelt it out in black and white on the app how I've done between 15 and 25 hrs most months apart from one which i was off AL and a few days sick where I did 5 hrs . Stands out like a sore thumb we've been shafted.

I missed out because my manager didn't put in my OT for a week in October last year. Of course it was put in November but that doesn't help with this. Almost like the management were briefed to make sure people failed to hit 8 hours in at least one month...
