Can a customer refuse a non tracked?
Can a customer refuse an item that is not a tracked item? I advised him to contact the company if he wants to send it back. Is this right?

The customer can refuse any item.

Correct, if he refused it while you were trying to deliver, you should have take it back and kill it off with the red sticker and send it back to the sender.
