Hi everyone

Wonder if anyone has some advice.

I have been a victim of fraud and have asked the chairmans office to step in.

I sent a special delivery item valued at 460 pounds which was my engagement ring I had to sell on ebay as due to coronavirus have no money and cannot look after my family.

The parcel was delivered yet 4 days later the buyer stated that he did not sign for it and even started a money claim with the courts as ebay closed the case as saw it was delivered.

He threatened and blackmailed me with a ccj I gave in and gave him the money back and I now know he has my ring and the money.

The local delivery office has spoken to the driver who recalled the buyer opening the door and picking it up from the door step he knows the buyer as is a regular to the area.

This clearly is fraud against me and royal mail will royal mail help me with compensation and will royal mail take action against this buyer as he has used the virus situation to commit frsud.

I am extremely upset at no longer having my ring without all this happening surely royal mail should involve the police

Any advice would be appreciated.

I used to work at a post office and have never seen anyone so blatant like this before

I’ve no real legal knowledge so I could be entirely wrong but my gut feeling is that the Royal Mail stance will be that they have delivered the item correctly according to current conditions (it does say on the Royal Mail website that no signatures are currently being obtained) and have suffered no loss themselves so any dispute is between you and the buyer.

If this happened to me I would either contact citizens advice or report it directly to the police myself.

Other than that I can only wish you the best of luck in what sounds like a real crappy situation. This current situation has brought out the best in so many people but, unfortunately, there will always be the odd scumbag who will use it to take advantage of people.

Guys, she is probably well aware she made a big mistake in paying the refund. She’s asking for advice on how now to remedy the situation. She’s been a victim of fraud, blame the fraudster not the victim.

I also have no legal knowledge but I find it extremely unlikely that this person could have brought a case against you, the evidence is in your favour,he has no case at all, he certainly couldn't personally issue you with a ccj, as far as royal mail are concerned they delivered it as per current spec, eBay wouldn't have entertained a claim from him for the same reason, sorry but I think that's it there's nothing you can do.

If the postie and Royal Mail have followed procedure, I don't think there is anything they can do.

It might be worth contacting Royal Mail and explaining what you have told us - with the exceptional circumstances, they might be sympathetic if you push it (unlikely however).

I assume you have some details for the fraudster, so the police might be an option?

Fraudulent denial of receipt is sadly fairly common, gets a lot of posties and customers in trouble, and there's not much that can be done generally.

The only remedy in this situation, is for the person to realise they were scammed. And then put it down as a lesson learned.

I don't think it's possible to get the ring or money back.

This highlights why we should still do the job properly, I've read lots of comments on this site and by my colleagues at work that because we sign for items they think they can leave/post them without any recipient taking them in. Luckily the postman in this instance followed procedures but there are people out there willing to take advantage of us signing for items, so cover your backs.

Just goes to show there are some absolute scumbags in society, to do something like this is disgusting at the best of times but to do it the way the country is right now is unreal.There is a special place in hell for some people I’m sure.

I can understand that you were probably under a lot of stress and worry with this
and were scared that this person could cause you more so you gave in. Then realised
it was the wrong thing to do.

I would contact the Police and show them any evidence you have, also stating you
have a statement from the Postman who delivered the ring.

Also speak to a solicitor, possibly the Union one and get their advice, maybe a letter from them
would scare him into returning the money before it goes too far.

Maybe write to him telling him that you are proceeding with this and you will get
him charged with fraud and blackmail (because that's what it is) if he does not
return your money.

As Scooby mentioned: GET THE POLICE INVOLVED :thumbup

It's a bit dodgy now with us being able to use the XT1 code to sign for everything, but you say the Postie remembers the guy picking it up? :thumbup That's a Result... There's your Witness. :Very Happy

Some time ago (Pre CV) we had a Postie that signed for the Special and posted it. :arrrghhh Dickhead was one of those Flyers that just can't wait for someone to come to the door. :arrrghhh :arrrghhh

Customer said they hadn't recieved it ... they checked the signature .... it wasn't his. There was 500 Euros in the Special and the customer wanted his money! The DOM got the Police involved ... they went round there and put a bit of pressure on him ... and he caved. Result. :thumbup

I suggest you do the same. Everyone's going on about the increased levels of FRAUD during this CV crisis.... I suggest you use that as Leverage i.e Posties are no longer required to get a personal signature from the receiver Good Luck. :cuppa
