Our esteemed employers persist in defending and appealing the indefensible. They have repeatedly and wilfully broken the law yet feel that it does not apply to them.

The throw (RM) shareholders’ funds at the court cases. Eventually it would have been cheaper to obey the Regulations.

Shades of the Post Office Horizon scandal.

I believe that there is yet another case due to be heard at Leeds ET in the Autumn. Let’s see if RM/Angard put up the same spurious arguments and lose yet again.

I tried to read the judgment but got lost halfway thorough, agency worker yes/no, permanent yes/no, awr yes/no, what in lamens terms was it all about and what was the outcome.

I just had a quick flick through. They could have done with adding a overall summary at the end

In layman's terms the judgement disposes of any attempt by RM/Angard to assert that Angard staff are not covered by AWR.

Essentially it's the legal reasoning that underlies plain common sense.

The judgement is also very useful in the analysis of the respondent cross appeal and the abuse of process issue that RM/Angard are potentially exposed to in future ( as long as an ET Claimant pleads the issue correctly at first instance )

I wonder if RM will go back to having them as casuals and not agency, resourced by the local resource units. It would help if say a mech trained casual is needed, managers could get them in and not chance that person not being supplied by Angard
