Leave while off sick

Post by Fritterface20 »

I retired on my retirement date but had been on long term sick and when I left I was told I will not be paid my 3 weeks annual leave which I couldn't take because I was off sick, is this right of royal mail to do this.

How many annual leave days have you physically taken since April 1 2024?

When you say long term sick, was this previous to April 2024?

I went off work on 3 April 24 and retired on my official retirement date, I was due a weeks leave in April may and July and I was due to be on leave in Oct for two weeks and one week in Nov, I did not ask for the Oct and Nov dates I would have retired but was given those dates anyway, don't know why, I have been paid for the Oct and Nov leave but not the leave I missed due to illness.

You were paid, your sick changes to annual leave then back to sickness when you are long term sick.
You cannot cancel any pre booked leave they make you take it on the booked dates then put you back on the sick.
Your sick pay will have been holiday pay on those weeks in april may & july.

If you are on long term sick and you have leave booked, isn't the leave cancelled to be taken later? I thought you could not be sick and on leave at the same time, or is this a new policy?

You can't be sick and on annual leave at the same time. The annual leave that you would have taken when off sick is supposed to be credited back. By changing them to annual leave and then back to sick it quickly bumps them through the stages to a stage 2 or a stage 3.

Utter nonsense. any booked leave is always credited back if on long term sick.

NO IT ISNT.
They will make you take it as planned, you will not be allowed to build up 2 years worth of annual leave. (If off sick for 12 momths)

That is discounted for stage purposes, it is still treated as 1 abscence.

If they do this at your place it might be worth knowing that it's not legal.

Not just company policy, but the LAW. Sick is sick, if you can't take your annual leave from from work because you are already off sick it accrues and rolls over if necessary.

The employee can ask to take A/L instead, for example if being on sick means reduced pay but A/L would give them full pay, but they cannot be forced to.

Hmmm thanks! i stand corrected.
I have seen someone recently on LTS switch to AL then back to LTS (maybe it was their own decision in order to get full pay then) they have been off around 9 months.

You might be offered to use outstanding leave, once you are on long term sick leave and have used up the rolling (4 year?) limit of full pay sick pay and half pay sick pay (six months for each?), but it's your choice once offered.

Or at least that's how I remember it from summer '23.

As a rule you shouldn't be sick - take AL - then go back on the sick.
I have never heard of someone being forced to do this although I guess it does happen.

Something I do seem to remember but it's very sketchy and I can't find it is there was something about taking holiday off people who had accured a lot from being long term sick. Possibly management.

Not 100% on it though.
