Enforced Medical Retirement

I injured my knee while on duty in March of this year. I didn't take time off work but did consult my G.P. and advised my manager at the time. I also did what I could to speed up recovery. Unfortunately, because I tried to walk through the injury, I now have 'Planter Faciitis' which I've been told is a common ailment with posties.

I've been offered 'medical retirement' on the assumption that my condition will not get any better which means that Royal Mail will not tolerate any further absences by me. My manager is pushing for an decision. I am 52yrs old and so still have a lot of working years to fill. What I would like to get answers to before I speak to him is:

1) How much of a payment/lump sum can I expect for just over four years service (p/t)

2) Can I expect Royal Mail to re-employ me in a different capacity if I ask

3) Can I claim compensation over and above any lump sum

4) If I take retirement how will this affect any claim for benefits etc until such time that I manage to find another job

May not answer your question but can give some scope on a refused managed return to work or amendments to duty to help you stay in work. Not sure if you are covered under the DDA ( what ever it's called now ).

Right sorry about your condition IHR is after 2 years 34 weeks pay as part time your hours would help me give you an idea plus PILON (Pay in leave Of Notice) think it is nine weeks pay after 2 years up to 12 weeks if you have been their for 12 years or more. So pay rate x hours x 34 = + PILON 9 weeks or 12 weeks = so say 268 a week x 34 = 9083 + 2404 = £11,487 just a guess by the way not much is it.

It is treatable and curable and if you don't want to go don't go. Someone has worked a rough estimate at around 11k which is not a lot in this employment climate.

you should be able to get employment support allowance then get a diff medical with atos, which is different to royal mail

Making appointment with G.P. tomorrow to discuss injection into foot to relieve the pain. Supposed to last a few months but not a pleasant procedure. Manager phoned again today to push for a decision by me so thank you for all your advice. So far, everything stated in the joint agreement on long term ill health has been completely ignored/forgotten by my management. And I only got half-way down the first page of the document.

if you are unhappy at the way the procedure is not being followed ,raise a grievance at stage 2 as it is about a manager's actions .You may well consider a bullying and harassment case as you feel that you are being hastened into a decision when there may well be other options.
You have not mentioned your union rep,i presume you are in the union ?

does sound like they are trying to get you out before dda.
they have to wait about 9 months really before offering ihr but looks like they know thats costs them money
so dangling the carrot to save all that sick pay looks like what they are after.


if your inner london youll get about 15k for a 30hrs a week contract.

not sure about benefits because i was over the savings limit anyways although im sure i could of got earnings based jsa if i was actually planning on looking for employment....that lasts for 6 months regardless of savings....and yes the payoff would count as that.

My current contract is five days per week at 29hrs. I've been working for four years two months at the same office but taken off my regular duty due to being physically assaulted. I'm now in a floating roll which I admit I'm not keen on. Nevertheless I want to hold onto my job. At least until it all goes t***s up in the next couple of years.

I've asked about another role within Royal Mail, e.g. front counter etc but no joy there and the Glasgow Mail Centre is being scaled down.
Had a chat with my G.P. today. So she wants me to give it another fortnight and then she will administer a very painful injection into my foot. At least no one can accuse me of not taking a self-help approach to this.

Does anyone know where I would stand with the Department of Employment or whatever they call themselves now, if I end up having to take medical retirement.
