MAGISTRATES told a regular criminal they hoped his "silly" days were behind him.

Michael Muttram of Royal Navy Avenue was given a conditional discharge for his part in the harassment of an 18-year-old female post worker during her morning round.

Muttram pleaded guilty to using abusive language towards the alleged victim's colleague who had tried to intervene when another man allegedly attacked the woman.

Eoin McCarthy for the Crown Prosecution Service said that while Muttram had the sense to step away from the assault, he then "got involved, swearing and being abusive" and approached the victim's colleague "in such a way that there was aggression felt".

McCarthy told the court that Muttram refused to leave the scene and had to be arrested by police.

Ken Papenfus, for Muttram, said his client "accepted he had misbehaved and regretted the incident" but that he believed the defendant had shown a change of character.

Mr Papenfus said: "He is calming down.

"He has a partner and a child who have an excellent effect on him.

"He knew to step away from this incident at the time."

Chairman of the magistrates Michael Thomas told 28-year-old Muttram that he hoped his less frequent appearances at Plymouth
Magistrates Court meant that he was altering his ways.

Mr Thomas said: "We have looked at your record and it makes for sad reading.

"The only good thing about it is we are seeing less of you.

"Maybe at long last you are beginning to grow up and grow out of these silly things.

He added: "On this occasion – and exceptionally in your case – we have decided to give a conditional discharge of 12 months.

"Let us see if this is going to be the last time [you are here]. It would be a pleasure for all of us if it was."

The defendant was ordered to pay a £15 victim surcharge although no costs were ordered due to money still owing to the court.
