Ofcom names the UK ISPs required to log illegal downloads

Telecommunications watchdog, Ofcom has confirmed the names of the UK broadband providers that will have to act as mediators in the fight against online piracy. It recently published a draft of its Code of Practice in which it revealed initially, only seven of the largest internet service providers will have to conform.

Only those with over 400,000 broadband subscribers will be forced to conform to the Code of Practice meaning BT, TalkTalk, Virgin Media, Sky, Orange, O2 and the Post Office will be obliged to send warning letters to broadband customers suspected of illegal file-sharing. For now, smaller internet service providers are exempt.

Further details of those customers who have received three or more notifications from their provider within a year will be able to to be requested by copyright holders if they wish to pursue legal action.

The draft of the Code of Practice confirmed Ofcom is working towards establishing "an independent, robust subscriber appeals mechanism for consumers who believe they have received incorrect notifications". It has also claimed responsibility for dealing with industry disputes and for spreading the administrative costs of enforcing the code.

Ofcom has estimated the Code of Practice will come into force in early 2011, that is "no later than eight months from Royal Assent, including approval from the European Commission."

The watchdog promised to keep the government up to speed on how effective this Code of Practice is in combating online piracy.
