Former Rutherglen boss fails to overturn sexual harassment dismissal
A DELIVERY services manager fired by Royal Mail from their Rutherglen office for sexually harassing a female colleague and inappropriate managerial conduct towards female members of staff has lost his unfair dismissal claim.
John Laing (54) denied kissing a female postal worker on the neck as she sorted mail, making inappropriate sexual comments, grabbing and hugging her, and making her sit on his knee.
The woman also claimed Laing had called her into his office and engaged her in conversation before suddenly pulling her down.
She also said Laing had once tugged at the top of her shirt in order look at her chest.
On another occasion she had to bend down to get batteries from a desk drawer, and Laing made comments about oral sex.
The woman came forward and gave a statement when Laing faced disciplinary action following a probe into earlier complaints from another female employee about his conduct. The original complaint was not upheld.
Mr Laing was suspended and required treatment for depression shortly after the latter investigation. He was subsequently sacked.
The woman had previously given a statement saying Mr Laing had not behaved inappropriately towards her or to others but that she sometimes felt uncomfortable with his behaviour.
A recent Glasgow employment tribunal heard Mr Laing had transferred from his post as delivery office manager in Cumbernauld to delivery service manager at Rutherglen in August 2006.
The original complaint was made by a worker at Cumbernauld after his transfer. She alleged that Mr Laing made a number of crude sexual comments regarding her and a male colleague.
These included “You've sh***ed the gaffer”'. She also complained Mr Laing had grabbed her head, put it towards his groin and said “'give me a blow job”' then shut the office door, turned off the lights and put his hands on his hips.
Emma Bailey, an independent harassment investigator, interviewed several members of staff at the Cumbernauld office.
She reported a number of witnesses interviewed had disclosed that Mr Laing had behaved inappropriately towards women in the workplace, including stroking their hands, hugging them, and sitting them on his knee whilst in his office.
Mr Laing admitted he probably would have hugged female members of staff because they were feeling down but it was not sexual and done on the work floor, not in a corner. He denied having any women in his office sitting on his knee but agreed he would rub women's shoulders if they looked tired or fed up. He said he did not think he had given anyone a bear hug.
A further investigation was conducted by manager Gordon McMahon before Mr Laing was formally accused of sexually harassing the female postal workers and inappropriate managerial behaviour towards female members of staff. This included hugging and kissing the necks of female members of staff, making offensive comments, sitting with female members of staff on his knee and grabbing/stroking some female members of staff's hands/shoulders.
At his disciplinary hearing on May 14, 2007, Mr Laing denied all the allegations against him. He said he thought one of his accusers was the kind of person who would have “'belted him in the mouth”' if he had said anything of a sexual nature.
One woman said she thought his attitude was too friendly and she remembered seeing a young female employee sitting on his knee on a number of occasions. She said she had also heard from other girls they were unhappy with his behaviour.
Another said she found him “'sleazy”' and kept away from him as much as possible.
Following his disciplinary hearing in June 2007, area commercial manager Terry Allen concluded Mr Laing had sexually harassed the employee who had latterly accused him, and behaved inappropriately towards female members of staff but did not uphold charges in relation to sexually harassing the woman who had first complained.
The Glasgow tribunal ruled that Mr Laing, of 83 Clunie Road, Glasgow, who had over 33 years’ service, had not been unfairly sacked by Royal Mail Group and rejected his complaint.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.
