Re: Back pay if you have left the business
People are suggesting RM says you have to be employed on 18th December 2020. However, the law seems to say differently. You are entitled because you worked it - it isn't based on your relationship with your employer on the 18th December 2020.
Just because an employer says we are doing it this way, doesn't mean that is what is right in law.
Google, 'Back Dated Pay Deals' - the money is owed to those who worked there at that time this seems to have applied every time it has happened in the country.
It would take a very arrogant and self loving employer to go against what is lawfully right.
Write to the employer and request it, as I will be doing. If they refuse, find out on what grounds. You need this in writing.
If they say no, you have the option to raise an employment tribunal to request the unpaid wages. A judge would soon decide but the evidence is available that it is payable. Employment tribunals for unpaid wages are simple, and quick and you could easily do it yourself. Turn up with evidence you worked there on those dates. Take a copy of the agreement stating employees are due 2.5% pay rise from the 6th April 2020 and I bet your sweet bippin a judge would award you the money.

Will it be paid automatically if you left after the 18th or do you have to claim it?

It's a collective agreement between Royal Mail and the CWU, the CWU representing the workers. If you're not a worker when agreement is reached you're not represented in the agreement and you're not entitled to the pay.burton76 wrote: ↑14 Feb 2021, 13:28People are suggesting RM says you have to be employed on 18th December 2020. Only the company could answer that, but I would expect it would be sent straight to the same bank account as your pay was.Chupacabra74 wrote: ↑21 Feb 2021, 06:46Will it be paid automatically if you left after the 18th or do you have to claim it?

I think we know the excuse they're using. It's a collective agreement between Royal Mail and the CWU, the CWU representing the workers. If you're not a worker when agreement is reached you're not represented in the agreement and you're not entitled to the pay.
We know it's a legally acceptable practice.
It's just disappointing that both the union and business think that it's morally acceptable especially given what members of staff have gone through over the past 12 months.
It's not even likely to be a large amount of money in the grand scheme of things but it's just another example especially in the union's case of being completely tone deaf to the position that workers and ex-employees find themselves in right now. To someone who maybe lost their job last year and is struggling to find another, a couple of hundred quid could be a life saver.
