Today, after 14 months of PT permanant work I was offered a 40hr contract, partly cos I am now on a rural duty ( covering S/L )......but only for 3 months. Now my rep is no mug or screw stoodge, and has said he will to continue to negotiate, but this contract will become active from Monday & as I work in a satellite office from my rep, I've not had a lot of chance to speak to him, so I gave ACAS a bell & if I sign or even if I don't, but don't claim docket ( in other words tacitly accpet the new contract ), in 3 months time, they can turn round and tell me I'm not needed & not renew my contract :shock:

However, apart from the pressure I will be under to not claim docket, I am also thinking that if I do not take the offer as it is ( in the hope my rep can make it permanant ), then I may not be offered the opportunity again, which is equally bad as having no job........so what should I do?

BTW, my DOM is a temp DOM for the next 6 months, but he has been shifted sideways from every office he has been at for B&H ( including my own once before - although it was before my time ).
I don't suppose your mouth bleeds every 28 days, does it?

Well you've got three months to check it out. What happens to your early start allowance if new contract?

I never considered that! :shock: I presume I keep it. The problem with your suggestion though is if I use the three months to "check it out" then legally I have accpeted my new contract, with all that it implies......so if they want ( in summer ) they can decide not to renew my contract, I end on the dole & can't do jack about it :evil/mad

No I meant use the time, should'nt take that long to find out your exact legal position,then act upon it within the three month deadline. Don't sign till you know the consequences, start by claiming ot .
Not unreasonable to want to know what you are signing up to.
Bit of a coincidence ,the length of contract offered matches the period required by employment law to fulfill the tacit/implied acceptance period?

Sorry, I might have misunderstood, but speaking to ACAS today, the impression I got was, if I accept it from the off, then that is a total acceptance.....as it is, I am of the opinion that it might be best if I book my docket as if I am still on 30hrs p/w - and when they ask why, say that I really do want the 40hrs a week, but as my wife is on incapcity benefit, my first priority is to maintain job security. ( But as the temp DOM has job security already, he's alright, Jack! )

Oh I see.
Check out the employment law bits online,think youll find that any unagreed changes to your contract are deemed to have been given your tacit approval if you fail to object within three months, ie. this altered contract of employment achieves legal status after that time.{ bit like our later starts scenario}
So in theory you don't sign ,but they may pay you full time ,pension ,hols etc. but make sure to opt out within the time limit.

What I did notice in a previously nationalized industry was that any disputes , contentious issues etc were deliberately strung out to last three months or more so noone could take the Business to Tribunal as they'd gone over the qualifying period for unfair or constructive dismissal , breach of contract .

Also say if there was a wages issue and the business was in the wrong , it was "amazing" that payment was only done on the twelfth week which was a bit ? Sharp.

Maybe I'm barking up the wrong tree but RM tend to be thick and arrogant as they come or too clever by half and/or devious /underhand to the point of being neurotic .

That DUM sounds if he's back up to his old tricks and seems to be a right snake in the grass, but it goes with the scenery with RM . No wonder they hate this site .

The only advice in this case would be to refuse, unless they (personnel) put it in writing that in the case of no FT contract, you would revert to original. The DOM is has been looking at the pressure OT booked and this is a way to cut it down.

Right update - sorry for being late, but I got home 3 hrs late ( bloody car still not fixed, bloody engineering work on train lines etc, ), & crashed out till 6:30am :shock: till, I spoke to the one decent manager in the area & to my rep, and whatever happens, I will remain employed by RM after 3 months. If the 40hr contract is not made permanant, then I will be put on to a 35hr contract ( in line with other AGs that have been there for more than 3 months ). So it looks like I was flapping about nothing much.........but I will be speaking to the admin manager next week, and I will be asking for confirmation of the above to be put in writing before I sign anything & if nothing is forthcoming within 3 months, then I will put in a formal refusal of my contract........there might be a majority of eejits & incompetants masquerading as management round my way, but in my experience, they are not sadistic or cruel ( having said that, I've not really spoken or dealt with the temp DOM before ).

Thank you to you, and to everyone that replied - of course, if it does go pete tong, I'll let you all know ( only twelve weeks till it happens :crazy: )
