Ok im looking for some advice concerning a family bereavment,

on Wednesday just gone my Dad past away early hours of the morning,So i phoned in my office in plenty of time to make them aware of the stuation and that i would be taking a few days off which my manager said was fine.Now i got a phone call on Saturday from my DO which i missed but this morning i get another phone call at 6:30 asking fist of all how things are which i replyied ok considering the situation,I was then asked if i could go in and do a walk as they were short staffed and i had to go in still Box up the walk then take it out and deliver when i said i wasnt really feeling upto it my Manager changed his tune very fast saying that if i come in and give him a hand with getting the walk out he will see about me getting the day off on Thursday for the Funeral!!

HE then went onto say that each day i have off this week i wont be paid now as far as i knew im allowed 5 days off for imediate family now this being only the 5th day today and he is saying i wont be paid im just looking for some advice as to where i stand,Im only Part Time and feel that because of that fact on more than this occasion my Managers try walking over the Part Timers like we are Beneath them so any advice would be great ]

Unfortunately to a certain extent your manager is correct, you are only allowed one day off for a blood relative funeral, however if you are the person who has to arrange the funeral/wake etc then you are allowed five days, so I presume when you go back to work next you will inform him that you were the person who had to make all the arrangements.This is what happened to me when I had to deal with this unfortunate situation.

Very sorry to read about the unfortunate circumstances due to a family bereavement that you find yourself in.

FAMILY LEAVE/TIME OFF FOR DEPENDANTS
Employees have the right to take reasonable time off during working hours where
action is necessary by the employee to deal with crisis incidents affecting
dependants. A dependant for these purposes can be defined as the individual's
parent, partner, child or another person who may reasonably rely on the
employee for care.

The right covers emergencies, rather than for events which can be planned for
beforehand and for which other forms of leave may be available.
The circumstances in which this entitlement to time off exists include the
following:

• To deal with the consequences of the death of a dependant (e.g. to
attend and/or make arrangements for the funeral;
• To arrange for an ill or injured dependant to be cared for;
• To deal with the consequences of an unexpected disruption or
breakdown in care arrangements (e.g. where a child is involved in a
serious incident at school or during school hours).

It is unlikely that employees will be able to give much, if any, advance warning of
their intention to take leave in these circumstances. However, the employee has
a duty to tell the employer the reason for the absence as soon as reasonably
practicable (ideally at the start of the working day) and to give an estimate of how
long he or she expects to be absent.

However, where necessary, the
employee’s manager may grant up to 5 days paid leave per annum in total for
circumstances covered by Dependants’ Leave. The 5 days should not be
regarded as a contractual right or minimum entitlement for employees. Each
case should be considered on its merits and alternatives such as time off in lieu
and combining holiday and unpaid leave should always be explored and
implemented where felt to be more appropriate.

Managers should note that there is no set limit on the amount of unpaid leave
which can be taken in addition to the 5 days paid leave in cases where leave is
associated with the care of dependants. Managers should discuss the situation
with the employee and ensure that a reasonable period of time is allowed for the
employee to deal with the emergency.

A friend of mine who is a postie went through the same sad time. Our Manager told him he would only get one day off plus the funeral. I phoned our sector rep who informed me that that is a lot of Sh*te. You can get 7 days special leave plus extra time if you are dealing with the funeral. Plus if your mum is still alive and needs help then that is allowed as well. Get in touch with your area rep and then tell your manager that you will be off until after the funeral.

all i can say that rm dont give a s**t about anyone or anything,my little boy had an accident couple of weeks ago,i phoned in telling my gaff the situation,said it was ok for me to be off,come thursday look at my wage slip and iv been docked a days pay,WTF

So sorry to learn of your sad loss. My father passed away this time last year.
It can be a very stressful time and people react in very different ways. Some people can just pick things up and get right back to work. Others find the stress so much they have to take counciling. Some even get pestered to get back to work far too early for themselves and find themselves then having to go to the doctor to be signed off sick with any range of stress related illness. Only you will know the path that suits you.

Thanks a lot for all the replies,I did get in contact with my CWU area rep and he told me i was allowed 5 days full pay if im arranging the funeral,Which means unless i want to loose money and to be honest on a part time wage i cant afford to i have to go back to work tomorrow Wednesday and then off thursday for the Funeral Its at times like this when i realise what a heartless bunch of W**kers i actually slave my guts out for!!!

I won't comment any more as i am seething at this business's lack of compassion..................
