Duty holder

I have been a duty holder for nearly two years, i got fair and square (order of seniority of applicants). if someone comes out of the woodwork two years later and says they where on the sick at the time and wasnt told about the duty advertised , would they be able to take it of me two years later? the person might be blagging me just two years later seems a bit of a dirty trick .
