Is there anything legally RM can do to a new starter who can’t drive, in regards him being not taken on if he doesn’t learn?

Under legislation, from 2010 workers can only make a claim for unfair dismissal once they have been working for a minimum of 2 years. So legally, and worst case they could dismiss him unless the reason for dismissal was automatically unfair.

As to the new starter not being able to drive, as far as I know, all contracts/adverts for delivery staff have required a full UK licence for a number of years. So I would ask how he got set on anyway. I don't believe there is anything legally wrong with RM imposing a requirement for a permanent contract such as getting a full UK licence, especially as being able to drive is a basic requirement of being taken on now.

In any case, his best option is to call in the big guns and get an Area Rep in the loop. I would also suggest contacting ACAS as well to get a 3rd opinion.
