Is it a breach of data protection to post a photo of benson&hedges or do you have permission?

Unless the person is called Benson and he is stood next to some hedges?
That aside, how can it be a breach of data protection? It looks to me that the original photograph was taken in a public space somewhere. If there was an image of a brand name being used, then its unauthorised use of the trademark,unless I am mistaken ,which has been known.

Had to use 2 bags on some loops with the aldi, my back was killing!
