Dismissal letter Query

Post by DM66 »

Hi, I've been at my depot for 14 years. The last 2 years I've had ongoing problems and time off because of Anal Fissures (anyone? The worst pain ever!) and chronic IBS which is stress related.
Anyway I had a stage 1 last October 2017 due to this illness and as far as I'm aware Ive not been ill again since then until last week (May 2018) when I had 3 days off with the same ongoing problems.
My Dom knows I'm suffering with it and stress related to it. He's been quite understanding I suppose.
Ive been on holiday this last week which was ruined again by this illness.
First day back after holiday still unwell so went in to show my face and then straight back out to docs to get more help. my manager was ok but said he'd had a letter regarding possible dismissal while I was on holiday.
Needless to say I was shocked for the reasons below.
Firstly I've not had any notification of a 2nd or 3rd stage warning since the 1st one last autumn from any managers at work so how can I be issued with a dismissal threat? I put this to him and he says he dosen't know and has to look into it.
He did however tell me I was ok and not too worry as I'm covered under the DDA. I had to ask what this was as I didn't know but more importantly I wasn't even told I was in or covered by DDA by him or anyone else in authority.
Also when I did return from my last illness no 'return to work' took place either which led me to believe I was ok in terms of days off sick not triggering anything ...and then this.
There seems to be a serious lack of communication between posties and managers.
So basically I've gone from a stage 1 to dismissal without any notifications or further warnings. This surely isn't right or even legal is it?
Id really appreciate clarification on this as I know Im going to have this problem for life.

Can you please advise what the reason was given for consideration of dismissal in your letter?
It is certainly not for your attendances going by your post as the last recorded review stage was a stage 1.
Your medical condition covered by the old DDA was incorporated into the Equality Act 2010 and having suffered this condition for a period of 12months which would have a sustained and adverse effect on your day to day wellbeing would be covered in the Equality Act.
Your condition should be discounted from calculation of absence days in the attendance procedure.
There certainly seems to be a serious lack of communication as you have stated and your union rep should be investigating the fact of you receiving a dismissal letter causing you additional stress.
Not to worry management have certainly made a completes pig ear if this and need to be reminded strongly that this letter should not have been issued.

You need to fill out an Employment Tribunal one form or ET1 form. Claim Disability discrimination and put the pressure back on Royal MAil. The Branch should assist you with this.

if you haven't had a stage 2 or 3 (RTU) since the stage 1 was issued, then do not worry one iota!! they haven't got a leg to stand on. they have broke every procedural agreement in the book. it cannot happen. (dismissal). in fact if the stage one was issued in October, then you will have even been removed from that by now. its been one almighty balls up and if your rep doesn't sort it go straight to area rep or branch.
