Since the back pay relates to a period of employment already worked under contract I doubt that position will hold up at an employment tribunal, it's just a guess because tribunals can be a lottery but they don't tend to like arbitrary positions like "good leavers" and "bad leavers".dingo wrote:It will depend if you have been a good leaver or what they consider as a bad leaver. If you're contractually entitled to pay up until the point you leave or are dismissed it legally has to be at the same rate as it would have been had you not been dismissed otherwise it's considered an ex post facto or retroactive punishment.
