Taking holiday pay as cash instead of leave?

Post by Supermac0151 »

Does anyone know if you can request to be payed for holiday leave without actually taking it off, I have over 3 weeks leave to take and can't see anytime I'll be wanting to take it so wandered if it's possible to just have it payed as a lump sum or do I just lose it if not taken? Thanks in advance.

It happens in some workplaces but should not at RM - it's illegal for a firm to facilitate your relinquishing the annual leave entitlement laid down in statute. If the DIM or RM allows it they could get into trouble. So the answer is no.

It has happened in my office lol when rest weeks have been owed back bank holidays, our union rep would come round and ask everyone if they wanted the day back or to be paid instead.

Most take the money as booking any time off is a bloody nightmare!

This is completely different from what the OP was asking, getting paid instead of taking a day in leiu for a bank holiday is fine.
Getting paid for untaken annual leave is not fine.

The government agrees with you smileski
Getting paid instead of taking holidays
The only time someone can get paid in place of taking statutory leave (known as ‘payment in lieu’) is when they leave their job. Employers must pay for untaken statutory leave (even if the worker is dismissed for gross misconduct).

In my office, when annual leave is not required it is possible to work the full week or part week on overtime.

Just depends on staffing levels.

Not only is that against agreements with the Union, its also technically illegal. Not for the worker, but the manager can find themselves explain to a court why he hasn't allowed a worker his statutory leave. If you work on you statutory leave, in law you haven't taken it, and it doesn't matter a jot if you agree, or you are paid overtime to do it. The manager in not allowing you the statutory leave, by working it, is breaking the law.

You are correct! I didn't read it properly. Apologies!
