the way forward
where in the way forward does it say that you must take a break before you go out on delivery. it says 20 +20 is a probable pattern.

It doesn't, but your dom can schedule your breaks, he may need to go through the ir process if he tries to do that and your rep lodges a disagreement but you would need a fairly good reason to fight it other than you simply don't want to

We have some duties where you have to take your first 20 mins only an hour after starting work

The business has a duty of care towards our health, safety and wellbeing, and in stipulating a break prior to delivery i would imagine they will argue they are doing just this.
The problem then becomes how do you manage this ?

i dont know your office but the stipulation would be in your 318 or walk log, i would imagine there may well be an element of flexibility with regards to the m/r, but this flexibility would be to your advantage/benefitsjnb6 wrote:is this stipulation written down ?
My personal view is that all m/r should be planned prior to delivery, this would come with the caveat that all individuals could choose to split m/r if they wished. Point being, if i was the rep it wouldn't matter what i did when planning the duty structure there's always someone who knows better or best and by putting the m/r all together and giving individuals the choice at least that way people can plan and work to what suits them best. For arguments sake an individual could say to their lino they would stop at the shops on their way out to their delivery and take a 20 min break then
What is written down (in law i believe) is that no working day is allowed to have all of their m/r planned at the end.

I worked in an office where the DOM "laid down the law" that everyone was required to take at least 20 minutes of their meal break before they left the office, with the remainder time being taken whenever desired including coming off the end of the day if you wanted.
