Former employees of Plymouth City Link depot consider legal action

Former employees of the Plymouth depot of City Link are considering legal action after losing their jobs when the company went into administration.

55 people in Plymouth lost their jobs when the parcel delivery firm stopped trading at Christmas.

The employment team at JMW Solicitors LLP has been contacted by more than 100 employees regarding a possible group employment action against City Link, who entered administration on Christmas Day.

At the start of January the administrator (EY) announced that 2,586 staff would be made redundant and as of 15 January 51 depots closed permanently.

Plymouth remained open with three staff to aid the administration process.

JMW has been contacted by former City Link employees from depots nationwide wanting to sign-up to make a claim .

All dismissed employees are entitled to notice pay (up to 12 weeks depending upon length of service) and up to 6 weeks’ accrued holiday pay which if unpaid can to some extent be recovered from the Department of Trade and Industry.

All employees who have worked at a depot with 20 or more employees will be entitled to become part of a collective bargaining group and pursue further compensation of up to 8 weeks’ pay from the Department of Trade and Industry.

Whilst these cases are at a very preliminary stage, the early indications are that each employee may well recover several thousands of pounds depending upon how the case progresses.

Carl Moran, a Partner in the employment team who specialises in group actions said: “Our experience in similar Group Actions has been that as soon as we begin to receive enquiries from employees, the case quickly gathers momentum and we are able to drive the case forward by establishing a critical mass of employees wishing to join in with the claim.

"These cases can often be hard fought, but that is what we are here for, it is what we are good at, and we expect a successful outcome.”
