Guidelines regarding indoor work this summer?

Post by weakerthan »

Hiya, I was wondering if anyone could link me to the documents regarding Royal Mail not having to provide indoor work to employees off sick this summer?

I was made to go off work in June and despite my doctor and OH trying to get me back I am still sat at home doing chuff all... I just wanted to read through this policy that apparently exists to see if it still applies in September as I'm beginning to lose my mind :arrrghhh

Thanks in advance!

There is no policy for or against this, there is no requirement legal or otherwise that makes RM provide alternative work for people who are currently unable to complete their duty due to illness/injury, if you are not fit to do your duty your dom can send you home on sick leave, he does not need to provide you with work you are willing or able to do he can insist on you doing the job you are employed for. Also if he does send you home your absence will still count towards stage warnings etc

however if you have a long term disability who is covered by the equalities act then RM has to make reasonable adjustments to accommodate you

As a shareholder, wouldn't this be seen as a bit of a waste of resources seen as other staff are given overtime pay to perform duties that you could be doing instead of paying you to be at home??

Thanks for your reply. When I was made to go off my manager specifically told me that they were unable to find work due to a specific new summer policy, so clearly either she was making excuses or she has her wires crossed somewhere.

Does that mean that everything I need to know regarding long term sickness is in the agreement? As I am struggling to find anything other than vague things about management having to try to find alternate work, including in other offices (which I believe my manager has not done). It also seems unlikely that something would not have come up for me in the last 3 months, especially when I know they are bringing other people in on overtime.

I read today that meetings are meant to take place at day 28 and week 12 of any absence. I have had no meetings and very little contact (certainly not weekly as suggested in the agreement). Would this work in my favour in terms of going on a stage?

Thanks again.

What he probably meant was that due to there being generally more available hours in the office during the summer months any indoor work would be covered by using up these "spare" hours

Again even if they are bringing other people in on overtime to cover indoor work, you have no right to insist on doing that work, you dom can choose to pay the OT instead of bringing you in, there is nothing apart from common sense against him doing that(again the situation is different if the reason you cant work is covered by equalities act)

Depending on your illness or injury then the level contact required may not require a meeting afte 28 days or 12 weeks, ie if you had say broken a leg and had a doctors line saying that it was going to take 6 months to heal due to being a very bad break then the need to meet up with you after 28 days or even 12 weeks would be pointless, both you and your dom would know the situation and your likely return date, not having these meetings may help you in the event you get to a stage 3, if RM have not followed the correct procedures they may not be able to dismiss you

Yes it would be a waste of resources but individually not much you can do to about it unfortunately, at the end of the day us workers collectively own less than 20% of the company, so we actually dont have that much of a say on how things are run

these ''reasonable adjustments'',,,,,can they be permanent adjustments.

yes and no, the reason for the adjustment may go away, ie recovering from a long term disability so no longer needing them, RM could then insist on changing back, so in that situation its a no, but if nothing about the condition changes then generally yes they would be permanent unless the situation changed where as "better" reasonable adjustments became availible

Ask your DOM to refer you to OHAssit to help identify work you are capable of doing. Be proactive and talk to your DOM about what you can do I.e. enquiry office, RLE, prepping, sorting, putting hazards on WRAP.

I was referred to OHAssist 3 months ago, and this entire time they have said I'm fit for indoor duties and have been regularly contacting work to pressure them into finding me something... but to no avail! I've been proactive; I was practically begging my manager to allow me to come into work, but there's only so much grovelling you can do when it gets you nowhere, and I won't be doing it again.

I am under no fixed timescale for recovery and therefore I believe I should have had day 28 and week 12 meetings. Aren't these meetings meant to help me return to work faster? With such little contact it barely feels like I even work there anymore!

If the money's going in the bank every week, then you're still employed :chuckle

And any bank holidays and pre-booked holidays that have happened during your sickness period need to be credited back when you are able to return. :Very Happy
