Part time cut off and flex?

Post by ddtc »

Hi I'm a part timer on a 25hr contract starting 9am till 2pm. I've been reading on here and just need some clarification on some things.

I'm entitled to 30mins meal relief? If so today I asked how much break I get, and the answer was none.

Cutting off - Told they are not allowing me to cut off and instead would flex even though I stated I could not work over my time. Also what time should I cut off at taking into account I should have a 30 min meal relief.

Since the revision started about 2yrs ago myself and a few other part timers have worked over our contracted hours. Personally I have worked at the least 32hrs a week. As we all know we get pro rata everything. But as we have been regularly going over our contracted hours should we of been paid more for annual leave, bonuses etc?

Lastly the same part timers have had been on a rota where we know when our days off are like full timers but it seems that soon I will be going back to random days off and only request a Saturday off 1 in 6 weeks although this is not guaranteed as I have found out from the newer part timers. Do I have a choice in this as I have not been told about my days off changing and I have made certain plans taking into account what my rest days are and will be?

Sorry for all the questions but the union guy at our office is useless and leaves us part timers and even full timers trying to find out everything.

Thanks

Unfortunately most part-timers are "encouraged" by their p+l partner to come in early, so both can leave a little early. The only person that benefits here is the full-timer as the part-timer can't really claim for overtime as technically he's leaving early even though he's done more than his hours. Absolutely no allowance is made for any breaks. And if you ask you're DOM all you get is a blank stare. Wish I knew the answer myself.

If you are working a 5hr day you are entitled to a 30 minute meal relief.
The timing of the break should be scheduled.

They can ask you to flex. It is not obligatory.
If you are taking your meal relief at the end of the duty, then your finishing time is 1.30pm. You then need to allow sufficient time to return to the office and complete the end of duty tasks.

The issue of your annual leave is currently being studied under European Law.
There is a possibility you should be paid the average of your last 12 weeks, (if you worked 32 hours/week, your annual leave pay should be 32 weeks and not the 25 of your contract).

The position of reserves isn't good. You are entitled to the same number of Saturdays off as the rest of the office but not necessarily in the same structured fashion.
If they are changing your duty, they should give you some notice of the fact, and if you have made arrangements then you need to bring it up as early as possible and you will need the help of your useless rep to ensure they are honoured. You always have the option of contacting your Area rep if you get no joy at a local level.

Would love to see how they schedule a 5 hour part-timer into a p+l loop. Taking into account breaks, re-directions, packets, bundling and bagging, van-checks, travel to and from office and time at end of duty that would leave only 3 hrs for actual delivery. Don't even want to add lapsing, deliver to neighbors and soon collections into the mix.
Square pegs round holes I think  Oh and also no overtime or cutting off.
If new start's followed the rules to the letter, they'd be out of a job in a week.

Thanks clash. I'll ask them tomorrow if my start time is actually 9am as it seems the most recent partimers seem to range from 9am to 9:15am start.

As for duty, I don't have one. 3 weeks ago I was on 3/4 dutys as cover with a random 1 walk a week. Now it seems I'm back to when I started and being put on random walks. But I assume the rules still apply on having 1-6 Saturdays off.

How do I find out who my area rep as I would also safely assume my useless rep will have no clue or won't be asked.

And newbie001 I understand what you mean and I'm pretty sure most know it goes on. Whats getting to me though the past weeks the managers have been putting 2 part timers in on a duty who do not know how to do the walk and so will struggle. I'm fairly alright now with most walks, but it gets to me why they cannot rota someone who knows the duty with someone who doesn't know the walk rather than have two posties not knowing. Also they come in at 9am and obviously still have a lot to throw in.

Just getting really fed up the past weeks with not knowing what us part timers can and cannot do etc.

But yeah thanks again, I've learnt more on this forum reading the past couple days than what our rep has in 2/3yrs which is pretty much nothing

Thanks spiderj.

So could management refuse me cutting off today then and asking me to flex even though I could not go over?

Just did not know what to say really when I was there.

Just tell them that as you have other obligations after your contracted scheduled hours of attendance, that you respectfully decline their INVITATION to flex.

If they wish to get more information about your obligation, then ask them what they are doing after work. ie. it's none of your fecking business!

Flexing is entirely voluntary

One word of advice though

Keep a trusted witness nearby when politely refusing

Cover your donkey at all times (ass)

Also n anon email to just say it can shine a light on confusing situations

Yeah I know that I do not need to tell them what I'm doing because its my life. Plus what is the point in a start and finish time.

Just annoys me as I have never cut off in my time as a postie and the first time I honestly knew I was going over and could not I get what happened this morning. But when other of my colleagues have they are alright with it. All this just needs to stop but anyway thank you, at least I know where I stand now.

You can always contact your Branch Secretary and he/she will put you in touch with the relevant rep - not necessarily the Area Rep, maybe a well-informed rep from a nearby office who can assist.
Ahebban - anglo-saxon in origin - meaning 'Wages War'
