no a penalty cannot be increased by an appeals manager . You can only lose your appeal or win and have a lesser punishment or indeed be exonerated

Sounds like the `classic` management bullshit of"if you appeal I can increase the penalty" is still alive and well in RM these twats reel out on a regular basis to stop people appealing. 
Feck them request every bit of paper to do with your case, bury them under paperwork.

would this also be the case if a Gross Misconduct charge which recieved a 2 year serious warning but the appeals manager states that it can be increased to a suspended dismissal penalty.
