Gross Misconduct charge
If someone is formally charged with Gross misconduct under Mails integrity, should they still be delivering mail whilst the case is on-going?

what managers perceive as gross misconduct is usually not that gross. case still to be proven. suspicion of theft usually see's people suspended. probably depends on staffing levels at unit if your suspended or not.

They can't argue for a dismissal if they allow someone to carry on delivering.
If the person does it again (whatever "it" is they have been charged with) then the manager will be picking up his/her P45 as well.

Need some clarification here by your posting which states that someone has been formally charged under mail integrity so I am taking it that the fact finding has been completed and it has continued on to a conduct code issue where at the conduct code interview there was a note taker which has resulted in this charge which covers gross misconduct and are awaiting the decision and the degree of punishment.makingsounds wrote:If someone is formally charged with Gross misconduct under Mails integrity, should they still be delivering mail whilst the case is on-going?
If my assumption is correct and the charge is correct then the initial action by management should have been a precautionary suspension to prevent further breaches of mail integrity.
By allowing this person to continue working then it demeans the stance taking by management of imposing a charge of gross misconduct for mails integrity and this should be the argument put forward by union rep before judgement is decided on this person.

I had a fact finding interview after which I had a letter stating I had to attend a meeting for gross misconduct. Attended meeting 5 days later summoned to office and dismissed. Whole senerio took 8 weeks, they had me on indoor duties until dismissal, the management told me they do not have to suspend you if they dont believe your a threat to mail. Can't go into any details as I am fighting this decision at present

So my question is what is the specific circumstances that warranted the charge of gross misconduct under mail integrity.
Trust you have appealed the decision bearing in mind that at appeals meeting you can request witnesses and copy documents/statements as to how management reached this decision.
