this subject has been answered before on previous forums. Flexibility is 30 minutes on a swings and roundabouts basis and is purely VOLUNTERY.

Teebs, ref Fishtanks thread. Legal Protections for existing agreements.

If the Pay & Mod is not legally protected in the clause 2 list, what effect will this have on flexibility?

Hmmm - I think it will have no effect.

Its still an agreement between the 2 parties just that we won't be able to take any legal action against them (sue, writs, torts etc). Which means there are no changes from before today so we can still rule 13 and/or raise disagreements, and of course individuals can raise grievances against managers for failing to apply the appropriate agreement correctly.

That should raise a few Joint Statements.

To review, by 2016, all existing agreements which remain current and distil these down into a single agreement covering working arrangements within Royal Mail which will provide a single reference source for everyone in the future.

Did I not see somewhere that Royal Mail were going to water down the flexibility rule whereby any flexing time must be given back in the same week. They want to be able to role it over beyond this time period. So this is probably why they want to change the existing agreements to get rid of any obstacle that stands in their way.

Some of our management don't even know if their staff are in never mind carrying over time owed or getting overtime paid so how would they work this pile of crap!

Whatever they do it's still voluntary. Half an hour of my post-work time is worth more to me than starting 30 minutes later one morning with just as much work but less time to do it in. Bollocks to flexing.

It's in the agreement you've just signed up to.
Point of Clarification on 30 mins Flexibility

Both parties re-affirm their commitment to the 30 minute flexibility arrangements within the Pay and Modernisation agreement. The following provides clarification of the agreed approach.

Where necessary, for example when traffic volumes are unexpectedly high or resourcing issues arise, individuals may be asked and may themselves request to vary their duty times by up to 30 minutes on a swings and roundabouts basis. Individual circumstances will be taken into account and total weekly contractual hours will not change. This means that individuals may flex their duty times by up to 30 minutes on any given day and this will be balanced either way over the next 5 working days. However this period can be extended by local agreement. A local record will be kept. Any requirement to change times of attendance or flex will take into account individual’s personal obligations and responsibilities.
Now you're not entitled to it back the same week but within the next 5 working days which now effectively means you can flex on a saturday and get it back the following tuesday.
Also they've crowbarred the word "requirement" in there which doesn't look good and neither does "However this period can be extended by local agreement".

The point is that if they can change one part of this agreement they can also change whether it is voluntary or not.
