I have a general idea I am correct here but a certain manager believes that if you ring up after your shift on a Saturday, after being ill for a week, they still count the Sunday as sickness if you state you'll be back on Monday. Even though you made contact AFTER your shift on Saturday (and before Sunday).

Can they deduct another sick-date off you (Sunday) under these circumstances?

(I know, I probably could have worded the whole paragraph better - hopefully you get the drift)

There is nothing that states what time of day you have to report yourself fit for work although obviously there still has to be someone there to take the message.

Would a recorded message stating fitness and return to work (on a saturday - FOR monday obviously) mean the Sunday is not calculated in the sickness?

I do not see why these Sundays should be calculated as lost days, especially in these scenarios. It's fraud.

I know a bloke at ?? Mail Centre (London) who is on a 4-day week. Many times he has phoned in sick and phoned in again on the fourth day of absence to say he's fit for work and will be back next week. RM have never counted any of those sickies as being more than 4 days. So if he can get away with phoning up and not actually returning until 3 calendar days later, there is no way you should have Sunday counted. Speak to your rep

If you’re off work sick for seven days or less, your employer should not ask for medical evidence that you’ve been ill.

If you’re off work sick for more than seven days, your employer will usually ask you to provide evidence or proof that you’ve been ill. They will normally ask for a fit note from your GP. Fit note is the informal name for the Statement of Fitness for Work. Fit notes replaced sick notes from April 6 2010.

The seven days include days that you don’t normally work. So when you work out how long you’ve been off sick, you should include weekends and bank holidays.
Sickness of seven days or less
Your employer can ask you to confirm that you’ve been ill. You can do this by filling in a form yourself when you return to work. This is called self-certification.

Self-certification forms
Self-certification forms usually include details such as:

•information about your sickness or illness
•the date your sickness started
•the date your sickness ended
These dates may be days that you don’t normally work. For example, your sickness could start or end on a Saturday, Sunday or bank holiday.

If you tell em you're fit for work after saturdays shift ends, then sunday doesn't count as sick.
If you're off sick wednesday to wednesday, then they count the sunday as a sick day.
If you're off sick during the week on the run up to annual leave, then you've always to be sure to ring up before your annual leave starts, to stop the sick leave. Unless of course you're planning on claiming the annual days back.

Point is - as soon as they're told you're no longer sick, then the sick days stop. They're sneaky as f*** with those sundays. I've seen so many people trigger stages through mis-counting.

CWU members should also be reminded that if they are well enough to return they should advise the manager even if they are not due in the following day, e.g. sick leave ends on Friday - RTW on Monday - If you do not advise your manager then you will probably find that Saturday and Sunday are classed as sick days as well.
