Quick question

Just a quick one regarding hours. We are on 40 hours a week but 3 of the heavy days we work an extra 10 min and on Saturday work half hour less so the total is 40. My argument is if Saturday is your rest day then you've been made to work 40 and a half hours . They say it evens out over 6 weeks but I'm not on a 240 hrs every 6 weeks contract I'm on 40 hrs a week and that's what I want to work. Help?

make notes on the hours you are scheduled to work each week.
if it isnt evening itself out because you are a reserve.....small claims court.

My my their maths is bad.

Every week you work Saturday you are contracted for 40 hours, every week you don't you are contracted for 40.5 hours - where is the balancing - They HAVE to work your hours based on any agreements and contracts. They cannot make you work 40.5 hours unless your contract allows it.

I can see where they are coming from - in the real world with finishing slightly early or slightly late then yes you would probably even out. However, they cannot do that as part of a contract they have to arrange your hours so that you are expected to do 40 hours each week, no more and no less.

It has always been this way with longs and shorts.

For example:
Mon - 8hr
Tues - 7hr 30
Weds - 8hr
Thurs - 8hr 45
Fri - 8hr 45
Sat - 7hr 30

Week 1 with Monday as your day off you work 40 hrs
Week 2 with Tuesday as your day off you work 40.5hrs
Week 3 with Weds as your day off you work 40 hrs
Week 4 with Thurs as your day off you work 39.5hrs
Week 5 with Friday as your day off you work 39.5hrs
Week 6 with saturday as your day off you work 40.5hrs

Over the 6 weeks you work 40hrs/week.
If the office agreement is longs and shorts, that is how it works.

what happens if you are a reserve and your office has two duty types....ie. 9 day fortnights and 5 day ? note the 9 day fortnights dont have holiday cover so all reserves have to do it.

we were told if you get a 9 day fortnight duty tough.....you could get 2 days off in that week.

now my argument is that most of these duty holders will aim to take as much of their weeks off on the weeks that their 2 days off dont fall on which means there is a likely hood someone will end up doing more hours than they contractually shoudl throughout the year....was told tough.

thats what i have to do, im a reserve and do a different round everyday, i total my own hours up each day, ive had steh same prroblem as above, always get tuesday of ect which is the short day to make up for the long days, when i told them id be claiming, they said that i have no reason to,

whats also stupid, on some of our park and loop duties, the two postie which are a pair have different finish times? haha
