proof of DDA

hello i have constantly been told over the last few years by ATOS, union reps etc that the condition i have is covered under the DDA. what i need to know is how do i actually prove that i am,who actually decides etc

You might want to see if there are any places left on the disability champions course that the CWU are running the week after next at Alvescot Lodge, you will learn plenty and then be able to help your colleagues as well.

How do you go about finding out if you can get on the DDA course i would love to do it, as I am trouble at work and want to prove I have a disbility, I did ring head office this week but they said i had to get in touch with local branch, which i did last tuesday but not heard back from them.

Job Centres should have their own Disability advisors who should be able to give you advice.

You will have great difficulty proving that any condition is covered under the Disability Discrimination Act since it was repealed last year ;) It has now been replaced by the Equality Act 2010.

Send a application to your branch and at the same time, as time is tight drop Trish Lavelle head of education and training a line and she might be able to hurry your branch up. Your branch should have advised you to apply for the course.

Did you contact Head office Wimbledon or the address/number below? The Training Centre deal with course administration rather than HQ.

On previous Atos reports i've recieved, it states my medical condition likely to be covered by the dda, because it has lasted more than twelve months. Is having a significant impact on my ability to undertake normal daily activities.And without the benefit of treatment would also have an impact on normal daily activities.I assume these are the standards applied to all illnesses/conditions.Hope this helps.

Thanks Daz, that's a great link. There seems to be a lot of posts about DDA/EA maybe there should be a sticky with this link.

You can't really get proof that you are covered by the DDA (or Equality Act), the only way you could do this is if you have been to a tribunal and they have agreed that it should be considered. We are all covered by the Equality Act it's just a question if it needs to come into play or not.

The definition of a disability is pretty loose but ATOS or your GP will have a very good idea if this is the case, this isn't the same as qualifying for Disability Living Allowance benefits. If your manager chooses to ignore their advice then that would look very bad in a tribunal.

Disability Champions come from a diverse range of backgrounds and a wide range of sectors. The common thread is a desire to see genuine equality for disabled people in the world of work.

During the training Champions will establish the role within their workplace by carrying out workplace activities involving their colleagues at work, other trade union reps and their management teams.The course will help you raise awareness of disability issues and provide practical solutions to help employers affect real change in the workplace.

Who is the course for?

This course is for all union reps who wish to broaden their knowledge and skills and gain tools to carry out their role more effectively.

This course will take approximately 30 hours to complete delivered over ten weeks.

This course will help you to:

Negotiate reasonable adjustments
Raise awareness of disability issues
Conduct access audits of buildings, documents etc
Liaise with external organisations

Can I get time off to learn?

Union representatives who wish to attend TUC courses in working time should first ask their employer for time off with pay. The Trade Union and Labour Relations (Consolidation) Act 1992 and the Safety Representatives and Safety Committee Regulations 1977 give accredited union and safety representatives a legal right to reasonable time off with pay to attend courses approved by the TUC or their union. Guidance towards establishing what constitutes reasonable time off can be found in the ACAS Code of Practice (http://www.acas.org.uk/publications/pdf/CP03.pdf" onclick="window.open(this.href);return false;).

Representatives who find difficulty in obtaining paid time off to attend TUC courses should seek assistance from their senior union representative or full time union officer.

Can I get time off for online courses?

Online learning should not be seen as an alternative to paid release from work. The law still applies, whether learning takes place away from work or in work, at a workstation or in a company learning centre.

How much is the course?

This course is free for all recognised union reps from TUC member unions.
