Hi

can some one tell me if i stop using my car on delivery is that classed as unoffical industrial action. I am banned from the car park and unable to load my car up so i park in the recpetion car park and load my car up there. The manager has told me i cant do this so i said you sort out the drop points and ill stop using my car hes response was so your taking unoffical industrial action. I suffer from asthma and ATOS have said it comes under the DDA would i be able to get my pass reactivated on these grounds. Also the way i see it as its my car my petorl and my insurance and no where dose state i have to use my car on delivery in my contract. please could someone clarify this for me

Another question i have can the manager still issue a stage warning even if ur illness comes under the DDA.

You shouldn't be using your car on delivery in the first place so how can it be any form of IA. As for your Asthma :

There is legislation that may protect your position in applying for a job, and maintaining a job, if your asthma is considered to be a disability.

The Disability Discrimination Act (DDA) (2005) prohibits discrimination against disabled people in a range of circumstances including employment. Under the DDA, it's unlawful for employers to discriminate against disabled people for a reason related to their disability, covering:

application forms
interview arrangements
proficiency tests
job offers
terms of employment
promotion, transfer or training opportunities
work-related benefits such as access to recreation or refreshment facilities
dismissal or redundancy

RM may issue stage 1 etc for your time off due to illness but can not dismiss you for it. If you keep having alot of time off they can medically retire you though.

You do not have to use your own vehicle on delivery and your manager is bullshitting you!

Just refuse to use it, say it's broken down and leave it at home if it makes you feel more comfortable. There is not a single RM contract that states that people have to use thier own vehicle, because then RM would have to pay your fuel and insurance and they won't do that!

Speak to your union rep. If you're not in the union join today. If your union rep is crap then phone your area rep. Managers cannot force anyone to use their own cars. You are probably not insured either to carry mail in your car.

As I understand it the only way that someone could be done for Unofficial IA when removing their car for use in delivering is when a group do it all in one go, and then only if they can prove its been arranged that way rather than a coincidence. They may suspect that is UIA but would be on a sticky wicket if they tried to discipline someone for it, they have no chance if its a single individual.

DDA covered conditions - Whilst they should normally be discounted from the procedure they can be included but the Manager should inform you at a previous meeting that any future absence will be counted. It cannot be done restrospectively.
