Forced to change shift - short notice - updated

Post by 1234 »

Apologies for just wading in with a question on my first post.
I've been a long time lurker, never actually posted as I didn't feel I had any worthwhile input.
Thumbs up to Postman and all admin / mods and regular posters for a massive pool of information.

I have recently started to cut off and do the job properly.
I now feel I am being targetted for doing my job properly (surprise surprise...)
10+ years in the job so I am familiar with the various tactics employed by lino's

I am FT and have signed for my own duty - 0630-1430 (I am not a float / reserve).
I have been told (not asked) to come in at 1100-1900 on tuesday for training on a hybrid delivery collection next week.
This is not due to operational difficulties, I think they want me out of the way in case others start cutting off.
Basically it amounts to 72 hrs notice as I was told on saturday.
Not a permanent change, but that may well be the result if I go along with it.
Another FT had the same thing happen (put on same hybrid duty), local rep said no, he had signed for his own job
and contracted hours.
Due to short notice, I haven't been able to see lino or rep.

The main issue is what do I do on tuesday:
1/ Turn up at 1100 for the hybrid duty training.
2/ Turn up at 0630 (normal contracted start time).

My argument is I was not asked,
I had no opportunity to say I was unable / unwilling for shift change (told when lino & rep not there on saturday).
The hybrid is still covered as its training, so I would have thought no case on wilful delay.
If I do turn up at 0630 and seek union advice from local / area reps will I be ok,
or could I be hit with conduct code.
I am willing to turn up at 0630 just to make the point, even if I do end up having to work 1100-1900.
Thanks in advance for any help :cool

Yeah thats pretty much what I'm going to do, I'll turn up at 0630 and say I'm working my contracted hours.
I've had this kind of thing before cause I'm a stubborn b@stard :nana
Getting more frequent these days though, plenty of similar cases on here (general B&H).
Cheers for the reply :Very Happy

Turn up at 0630.
The hybrid 1100-1700 would constitute a major change in your attendance pattern and require 28 days notice if enforced or agreement from you to change if not.
They have neither so they have nothing. :cuppa

Cheers Fishtank & Postman :Very Happy
Should be a fun day on tues then, and hopefully an eye opener for some of the poor b@stards in our office.
Few if any have the guts to make a stand (small office used to being shafted), I've working in MC's as well
so I'm used to confrontation :nana
TBH on a more general note, it really is starting to look like its just a matter of time before more people say enough is enough :chuckle
Thanks again, I'll keep posting but only info posts when I'm sure of the facts.
I thought I knew a fair bit, but you guys know more or as much as good area / div reps :cool

To be fair, he states he has a union rep who has already put a stop to it once before, but on this occasion he couldn't get hold of him, re OP

Would this be the same if, say for example, I was working in a DO situated in a MC, and I was told that I was working in the MC the following week?

No...as long as there was no change to your hours this would be covered under pay&modernisation2007-working in nearby offices.but certain enablers should be present...

Working in nearby offices - Areas will identify and agree with the CWU locally an approach (which could include the use of Volunteers and Reserves) to working in nearby offices within employees’ contracted hours which will include travel times and appropriate travel and subsistence arrangements.

Considerations and Suggested Activities
Design and agree a fair approach for people to work in nearby offices. This approach should then be shared at
area level so that an area plan can be agreed and put in place that deals with foreseen and unforeseen
requirements. Weekly resourcing meetings should be used to identify any foreseen requirements. All training and
travel requirements should be included in the agreed plan.

Establish and agree an approach/process for working in nearby offices (including training).
Jointly review to ensure arrangements are robust and fair
good times, bad times you know I've had my share

Thanks for the prompt reply.

My situation is that I am a reserve in the MC, and I have been listed for a job in N+C's duties.

However I have not been listed at all in my parent offices duties, saying that I am working for N+C, or that I have any conditioned hours at all.

The fact that I am making this post says that I don't want to work for N+C.

Is there any reasonable (tbh I'd settle for unreasonable, if push came to shove) way to get out of it, or am I going to have to go in on Tuesday and ask my rep for the local agreement on loaning to other offices?
