people i asked to be taken back to the office to use the toilet as it wasnt a pee,that i was needing,now my h@s rep said that was allowed,manager on the other hand charged me for it,ps there was no designated toilet on my walk log(pardon the pun)
any advice or downloads would be welcome as its 1 of my charges at the tribunal.

no i wasnt on o/t,just on my delivery,he did offer the bookies and asda but as id had a bad experience with public toilets in the past(ie sumone had crapped down the front of the pan and i ended up with it on my trousers) i asked him to take me back to the office,which was under 2 miles away,and he refused

When you say tribunal I take it you mean you've stage 3'd. If the other charges are as stupid or you believe that there is a pretty good argument for them then persue this one. Your walk log must provide you with a designated location for toilet stops, if it doesn't and your Manager cannot provide you with an approved, safe alternative then they cannot refuse your request. If, as you say, your Manager provided you with alternatives and you cannot show good reason why those alternatives were unsuitable then you will be seen as having been difficult and it will not help you with your other charges. Obviously if the other charges are pretty water tight don't even bother wasting your energy on a the toilet one since winning it in unlikely to save you.

yip lost my appeal,if you can call it that,15months full pay suspension,none of my witnesses interviewed etc etc,the whole case and charges are very poor imo,17years service and clean conduct record
