atos RE-REFERRAL, whilst still on rehab
im back to work(nov 29th) after 5 months off. been diagnosed with osteoarthritis in the knee. been told i need a replacement kneecap. anyways, the dom told me last week he was re-referring me to see the atos quack for a face to face, his words were 'to get a clearer picture of my condition, and what action to take....' i didnt think much of it at the time, but when i went to see him, he had his notes on his desk and there was a report about me, which to my complete surprise stated 'rehab failed'. i asked the quack how this was, as i was still ON rehab, im 6 weeks into an 8 week plan. i havent been told or approached to say my rehab had failed. ive done everything i was asked to do in the plan without any problems....can they re-refer me in the middle of a rehab program if everything is going to plan?..anyway the quack said it was confusing that my rehab was down as failed, but went ahead anyway. INSISTING that i would not be able to do my full delivery by march??? even if i had my operation in february, stating that recvovery time would be outside rm recovery times. it looks like im being stitched up for ihr,..he is saying my time limit is up in march. it looks like my dom is counting my recovery time from my first day of absence in late june. i was under the impression your recovery time is AT LEAST 9 months from the date of medical diagnosis. which in my case was late october, which would give me till at least late july this year. he has give me a total shyte medical report. as i said, i feel im being stitched right up. can any reps advise please.

i am covered, but its looking like they want me out. as i said, he re-refered me in the middle of a rehab plan. he says i wont be able to do a full delivery. even though i said i would,nt know til my 8 weeks rehab was up. he didnt even examin me. just asked me to squat. then he said 'your knee is making a crunching sound....your (basically) cattle trucked.zoo wrote:Are you covered under the dda with that can they make you go back to full delivery cause i been diagnosed with neck arthritis and am due back soon.

Was it definately a Doctor that you saw?
I know that sounds like a daft question. But sometimes the people you see for these referrals, are just Occupational Therapists, or Nurse Practitioners. Did the referral letter actually say you were to see Dr. whoever. Or just that you had an appointment with whoever?
Either way. I strongly suggest that you go to see your own Doctor ASAP, and get a second opinion. Then if you were lucky enough to see a real Doctor at the ATOS Referral, and there's a major difference in the outcome of your second opinion (rather than just a small difference). Then I'd suggest making a complaint to the BMA http://www.bma.org.uk/ethics/index.jsp" onclick="window.open(this.href);return false; , of breach of Ethics. Specifically, not performing a proper examination, before making such a serious decision.
Obviously, I don't know whether he/she's right or wrong. That's why you need a second opinion. But if this is, yet another case of ATOS deciding what the Managers want. Rather than making a proper medial decision, then something needs to be done. Just don't tell your own Doctor, that you're considering making a complaint to the BMA, when you ask for the second opinion. And even if it doesn't come to that. It'd still be useful to have a second opinion to bring to your next meeting about your condition at work.

You should do a Freedom of Information Act to Atossers so that you can see exactly what the questions your Dim put down on this business referral, this is what the manager sent to the quack and not the report that Atossers says you are entitled to see after you've visited the quack ,it's worth it as most managers don't think you will be able to get this
and they don't half put some stupid and incrimminating things down in their questions to the quack,very handy if you have to take it farther.
