Can anyone confirm the conditions under which bereavement leave can be taken, and to which members of your family you are able to take bereavement leave.

The special leave policy allows for up to one week with pay for the death of next of kin and blood relative, (spouse or civil partner, child, parent, sibling) and one day with pay for parent in law (or the equivalent in a civil partnership or longstanding unmarried relationship), or grandparent.
Discretion for additional time off with pay may be granted in exceptional circumstances. If the circumstances are not exceptional, any additional time off granted will be unpaid, or taken as annual leave.
Discretion for time off with pay, in circumstances where the relationship to the deceased is not covered by the above, may be granted if the circumstances are ‘truly’ exceptional.
If the circumstances are not ‘truly’ exceptional, any time off granted will be unpaid, or taken as annual leave.
Note that under the Employment Rights Act 1996 s57A, an employee has the right to take unpaid time off upon the death of a dependant to make any necessary arrangements only. The purpose of this leave is to make funeral arrangements etc and this does not give the employee a statutory right to take more than a few days off following the death of a dependant.

Thats a great help Fishtank. We have a guy at work whose father in law passed away, and he has been refused bereavement leave because he is not immediate family. The office have told him that the rules have changed. Can you confirm that the details you have provided are the most up to date? Thanks for your help.

Sorted it out today, and he now ha his one day paid leave and is taking it up with the manager and the rep who told him that he wasn,t allowed paid leave. Thanks Fishtank and Postman for providing the ammunition to fight these nasty b..strds

Ok let's work this out,father/mother in law = wifes/husbands mum/dad.
Now wife/husband has to go to a funeral of mum/dad.
Are scumbag RM managers expecting these people to go to something like that without support!!!
A few years back the exact same thing happend to one of our guys,the manager refused him time off to go to his mother in law's funeral with his wife.
He had to come in on the day and was in pieces,in the end he had to be sent home.
This firm is unbelievable.

I have to say when Mrs Fishtank's mother passed away my boss was great,i was out on delivery at the time and they sent a van out for me,took everything off me and took me home.
When i phoned in the next day the DOM said take as long as you like,in the end i was off for a week and got paid for the lot.
Different DOM now...probably different result.

My dad died nearly 10 years ago and i was refused time off to go to his funeral, MY OWN DAD. The end result, i took time off to got to the funeral and 4 months off sick leave with stress.

The sad thing is that local cwu reps are supporting these managers by accepting what they say and not taking the time to get to the real truth. They should now be working on the basis that everything a manager tells them is a pack of lies until they do some investigations and get to the truth. Thats not to say that every manager is a liar, but working on the basis of probability.

I don't know whether it's the same everywhere or just a local problem. But when I needed time off to go to my Wife's Grandad's Funeral. I had to show the Death Certificate to my Manager (it had to be the original, not a Fax/Email/Photocopy), before he'd allow me to book the day off! (I used A/L). Believe me. It was a very embarrasing situation, having to ask my Mother-in-law. For her Dad's Death Certificate, so I could show it to my Manager to prove that he'd really died!
Luckily, she didn't mind lending it to me. Although she was even more disgusted with my Manager than I was!

I was too shocked to think of that. I'm just glad the p**ck left my shift a couple of years later. It's a pity I didn't know that it wasn't normal for them to deand to see the Death Certificate at the time. Or I could have put a grevance in.
