Annual leave allowance

Post by Thunderthighs »

Had quite some time off last year due to AOD's etc. This means, there's a backlog of Annual Leave and Lieu days owing to me, as far as I'm aware.
I've asked - 3 times- for a list of my outstanding 2009 AL. ( First time, it was forgotten, 2nd time, computer not working, 3rd time, as 2 but password not working...)

As I'm gonna be off for 2 weeks - head injury - getting a bit concerned that my AL will be overlooked/forgotten about, and I'll have to forfeit it.
Worried about cramming it in in March etc.
So, what can I carry over to next years AL, is there a limit? Do I have to get their permission etc? Do I have to keep chasing it up, or is it carried as a matter of course?

I know there's some that may say, "You've had enuff time off with AOD's..." but that's not the point. They were AOD's, proven and witnessed etc. Not my fault...

Five days I believe can be carried to next years allowance, more with a line managers approval.

AOD have nothing to do with annual leave and I would be the first to shout down anyone who suggested you have already had enough time off. :cool

fire it up imediately to your rep and give them till the end of your shift to come up with what they owe you.
then go to your area rep and so on.
keep a diary of your efforts, past and present to get this info and present it to your lino with your rep present, or a witness.
after all its YOUR annual leave.
Confused... You won't be, after the next episode of. SOAP

1st thing to do is just ask for your Holiday sheet for the year 2009/2010 (He can not refuse to give it to you) it takes him 20 seconds to print it off. On that it will tell you how many days you have outstanding. You may get forced to take your leave between now and the new holiday year (2010/201)1 which starts at the end of March/April.

Sickness

The European Court of Justice (ECJ) recently ruled on what happens if you become ill during your holiday or just before you were due to take it. You can ask to convert the period of holiday concerned to sick leave and ask to take the missed annual leave at a later date.

You should follow the usual procedure for telling your employer you are ill (eg letting them know as soon as you can or providing medical certificates). If you are not sure what your normal process is check your employment contract, staff handbook, or intranet.

You may be unable to take all of your holiday entitlement within your leave year because of illness. In this case, the ECJ judgment also means you may be entitled to carry forward the entitlement you would otherwise lose to the next year.

The government will be consulting in 2010 on possible changes to the Working Time Regulations in the light of the ECJ judgement.

If you need further guidance on this subject, please contact Acas for advice.

Carrying leave into another year
...Transfer of leave in excess of these limits (one week or five odd days) requires
written permission from the line manager, except that leave that cannot be taken
due to sick leave may be allowed in the following year.
Where this is granted and would
reduce the annual leave taken in a particular year to less than four weeks, the individual
must also confirm in writing that they are willing to voluntarily forego their statutory leave
entitlement under the Working Time Regulations 1998.

Way Forward, Section 4 Annual Leave.

Thanks, everyone! 3 requests so far have had...3 excuses about something or the other.
So, I'll request that I receive a copy and then hit them with, "So, I'm going to have to take 3 weeks in March off, OK?"

I'll contact the office this week.
