Lainey - Telemetry - I think it can be a good tool if used correctly and with full agreement by the workers so that they understand why its been deployed, and so that they know exactly happens if they breach any of the guidelines etc.

The problem at the moment is that there is no national agreement on it so Managers are bumbling along making up as they go along, not their fault its lack of leadership from above, and Posties who are counselled for bad driving etc because of it, again don't know what the consequences can be in the future.

would be illegal under employmet law, ONE we have a legally binding contract TWO in a legal strike we are on the right side of the law.

I can see them making everybody unemployed and sign loads of new staff with NO local knowledge and no vested interest plus a Class action court case by the CWU, it would prove very expensive in the long run for RM, daft idea before its even started.

What about the unoffical strike action going on just now tho up and down the country? Is that legal?

Nope variety of reasons

1. It would be illegal unless they did it to everyone at the same time. No picking only those who went on strike as they would have a massive compensation pay out.

2. Administration costs would outweigh any perceived benefit.

3. After 12 weeks they can sack all the strikers anyway under current law, if they follow the correct guidelines and laws. This would be far cheaper.

4. Bad PR for the government in the run up to a GE.

5. RM are currently talking to the CWU regarding Phase 4 - so why would they do that if they were going to get us all to apply for new contracts.

6. The wild cat strikers have not been dismissed and reinstated and if this was in the pipeline they would have been. It would have been to good an opportunity for RM to "test" the waters.

In the end its possible but highly unlikely.

yes you would be on dangerous grounds with that one, legally, when you go out unofficial you are effectively dismissing yourself, in practice its a little bit complicated, if it was one or two, RM would sack them or make them come back under a new and less favourable contract, when its a whole office its difficult, its been tried when RM made an entire Office come back on a new contract, this only resulted in the staff staying out even longer and were eventually reinstated under the old contract.
