Nothing stopping the employer inviting you in for a disciplinary procedure while on sick leave. It all depends on the reason and length of the absence, as in short or long term.

As long as reasonable adjustments are made if necessary, and the employee fit to attend cannot see any issues as it is a stage one, and not the dismissal stage.

You still have the right to be accompanied by a Rep or authorised companion

Very much doubt management would issue a stage without you in attendance as you have to be given the opportunity to give mitigating reasons for the absence such as equality issues etc. But saying that, any right to appeal the first two stages is null and void through a collective bargained agreement. How you can not have an appeals process for a disciplinary procedure is beyond me, and why it was agreed in the first place an abomination

Surely they can't give you a stage 1 while still on sick never heard of it being done before.

In what way.
Have you been sick, came back, triggered the stage, then gone sick again?
Triggering the stage while still out sick is near on impossible unless the screw has contacted HR.

It all seems a bit murky.
And is the rep aware?

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.
