Non payment of holiday money after receiving IHR

Post by the dragon »

Hi, I'm looking for some advice please. I took IHR about a month ago and received the payment very shortly afterwards. The problem is, they haven't paid my owed holiday entitlement. I've contacted my DOM and he said he would look into it but now when I contact him, he simply doesn't even pick up the phone. I've contacted HR and they said its up to my DOM to authorise it. Round and round in circles sadly. So any advice on how to proceed would be great. Thanks.

As the informal approach is not working, you need to send a letter in writing to your DOM via recorded delivery if you do not know his email address.

Remember, you only have three months from date you left the business to get redress

Head the letter Formal Complaint Letter before Action

Say something like?

Despite many requests, outstanding annual leave entitlement has yet to be resolved.
Can you please confirm immediately by email (Include your email address)?
That any outstanding annual leave entitlement will be included in the next paycycle

It is with regret that if this is not actioned, for whatever reason within fourteen days from receipt, a complaint will be submitted to the Employment Tribunal Service contrary to Section 13 Employment Rights Act 1996 and external mediation through ACAS

Sincerely

Thanks for the info 👆
Exactly what I was hoping for.
What really confuses me is why would my (ex) DOM be so dismissive of my problem ? He seems a decent guy, so why hold up my payment? Does my holiday payment go against his office budget in someway? All seems rather odd tbh.

Just as a matter of interest did he always seem like a nice guy when he wanted you to do something for him and now you are asking him for something it turns out that might not be the case? :d'oh!

Hi guys, thanks for help and advice. They have finally paid all backdated holiday pay due to me. It took a bit of help from HR, who eventually persuaded the DOM to authorise it. Cheers 🍻

Hi just wondering what the process was regarding the IHR. Did you have a final OH call? And if so how long was you waiting before IHR was confirmed?

Went sick with an operable condition in September, doc was giving me monthly sick notes.
I had a phone call from OH early December, basically clarification of my condition. Early January, met with DOM, he basically tried to get me back into work on light duties but, after speaking to my GP, he said " no return to work under any circumstances". A week later, another phone call from OH and they sent me a letter a week after that ( DOM got same letter) saying my condition was "long term" and recommended IHR. A week later, another meeting with DOM offering IHR terms. Officially left the business a week later. Money in the bank within another week ( excluding holiday money due but eventually got that as well). Tbh, I didn't really want IHR but my full pay sick was in its 5 th month and my health wasn't going to improve until I've had an operation, so a little reluctantly, I signed the forms.
So basically, sick started early September, two OH phone calls, two face to face meetings with DOM, offered IHR end of JAN, money in bank early February 👍
