im a part timer and a full time job came up. I applied, along with another ag who started at the same time as me, for a full time job and he got it, cos he was older, yet we started at same time, so it discriminated against me cos i was younger. This is illegal under a newish labour law, Therefore how can seniority still be valid in such circumstances. Rather than by how good they could do the job it was given to someone based on there age.
I have an idea of a way to solve it one is an idea thats probably hardly to manage but fairer. Stagger employing people and make them start at the bottom and as things are at the moment pick the best candidate for each job

I've only been with RM 12 years, there are people been in the job longer than me, some older some younger, their seniority will get them the pick of the jobs should a resign occur, i understood this when i took the job, i have no problem with it, as for best person for the job who decides, too much scope for favoritism.

Its not illegal, if 2 people start at the same time then it usually goes on test results and not age. If age was used as the decider then this is the discrimination part of it and so you can seek legal advice.drevil1969uk wrote:still illegal tho whatever way you look at it, i agree there has to be a way of picking jobs but the current system is over 100 years old isnt it?
But seniority is based on length of service.

I had something similar, what we did was toss a coin for it. I prefer the toss of the coin, you both get a fair chance of getting it.

You are right to say there is an illegality but you have it the wrong way round, age discrimination started last October and you couldn't discriminate against anyone because of their age - ie old.
Though on the subject of seniority, there are now so many exceptions and preferences it hardly seems worthwhile to pursue it and I do believe that the agreement on seniority is fast becoming under serious threat, the CWU are no longer as adamant as they once were that it be sustained - though IMO it is still the fairest way of deciding who should have which duty, given a level playing field, which of course it no longer is.
