There is no DDA, it's the Equality Act 2010. AFAIK, you are covered from the point of diagnosis provided the condition is likely to last 12 months.
I have chronic migraines (migraines at least 15 days of the month), new daily persistent headache (head pain that isn't touched by pain killers) and fibromyalgia (musculoskeletal pain). I was told by ATOS Dr that I was covered by the EA2010 before I was IHRd last year. Another Dr who works for the local council and saw me as a pre employment health check thingy told me the same. My conditions became chronic and painful in July 2010.

10 Downing St e-petition has just a few days left to go, If you object to the way Atos assess disabled people, sign the petition before 8 August

ATOS assessments
Responsible department: Department for Work and Pensions
We are concerned by reports of a high number of genuinely ill and disabled people, including those who are terminally ill, wrongly being declared fit for work by ATOS medical assessors.
These errors cause hardship and distress to some of the most vulnerable members of society and cost the tax payer large sums in appeals.
We therefore petition the government to look into the process of these medical assessments and ensure that the necessary changes are made to create a fair system that protects the sick and disabled.

Curiously after a long absence through serious accident my doctor said I could return to work on light duties. Then ATOS got a physio to examine me and they said...
NO! Not a chance of going back to work yet. :( Been off for another 3 weeks since then!
