Postman accused of stealing mail wins unfair dismissal case

You are all quite correct, Dave went through hell to get to the other side of his tribunal and won, he's part of only 1% who do. He will help everyone caught up in a similar situation going forward. Just wish others could be found that this has happened to already, who maybe couldn't fight. Dave's case will now be used in Employment Tribunals going forward, so hopefully this will make it harder for the likes of Royal Mail to do this again. HOWEVER, what really should be done - by the CWU or driven by them - is a full internal review of the IB staff and how they operate. Also how they justify/qualify their 'investigative' techniques, which are clearly undermined by Dave's case and the judge's report - this is a public document anyone can read it - it is definitely worth it. The IB act like 'police' - just what criteria do they hold for this role? Paying off a member of staff in Dave's position means nothing to a large company, it's peanuts (would do higher up the chain; what do executive's earn?), but posties are the spinal cord of Royal Mail, especially the loyal ones, every one counts, otherwise this company is redundant. No question they need to weed out the bad ones but when they make a mistake, morally if nothing else, they should address it. Are they saving face and any knock on effect of having to take Dave back?

David's reconsideration hearing has been rescheduled to 25 nov, after it was postponed from 9 nov. Hopefully David will be reinstated as the judge originally ordered and walk away with his head held high again, and we hope he and his family can look forward to a happy Christmas. I know he's thinking about Bridgewater right now and what's going on there, it's a travesty. Keep supporting the underdog guys, there's too many out there, rm can't be allowed to get away with it.

If anybody remembers the Royal Mail "REM 11" dismissal case, will also remember how RM lawyers kept putting back the court dates after losing the initial tribunal, they hoped to grind down the CWU legal team by financially draining the opposition and depriving the REM 11 of justice, it took years eventually RM caved in reinstating or compensating them or pay to the widows of some who died waiting for justice.

It cast a long shadow over industrial relations for a long time.


Be prepared for the long haul.

Nearly 18 months on - David has seen a bit of the long haul. He is very aware of the underhand tactics used by RM to disrupt and mess around with process and legal proceedings - believe this! But, he was never going to lie down and be called a thief when it is the last thing he will ever be. He has very strong support and it continues to build. This is what good people get and deserve, and this will help him carry on fighting. I know David's hope is that in doing what he is that he will help others to stand up and fight if they are wrongly accused. Help spread the word on his behalf. Get his Change.org (UK Employment Law: the judges decision should be final) petition out there round the rest of the UK - the posties need to know.

It's worth bearing in mind that the CWU aren't there to "change decisions" or to "get people off" but to ensure that RM's own stated rules and processes are followed fairly.
In a case recently of alleged IT abuse the CWU would only participate in the appeals process up to a certain point, and after that, guilty or innocent, you're on your own. These processes aren't a court of law but administered by RM managers, and we all know they aren't infallible..

You are always on your own, when you're an individual fighting an injustice, sadly very few people give up their time to fight with you. The point is royal mail managers in this case were so far beyond infallible it was truly shocking to listen to what they had to say when they sat under oath. And as for royal mail processes - this is exactly what the CWU should be questioning to make sure no other posties can be accused of theft with absolutely no evidence to show for it other than 'that's what the managers think so it must be true'. They are talking to Dave. Spread the petition, please and thanks!, it needs to get round all the posties.

Keep an eye on the Courier newspaper http://www.thecourier.co.uk" onclick="window.open(this.href);return false; for report on David's reconsideration hearing yesterday when Royal Mail's lawyer asked the judge to reconsider his judgement that RM should give David his job back.
The RM lawyer simply repeated a mantra over 6 long hours. The Cupar office manager is so stressed that he could not have David back working for him in the office and RM would have to employ a 3rd manager to follow David on his round if they took him back, at great cost. But, the Cupar manager was not there, this came from higher management.
There was a point when the spectators laughed out loud.
CWU Union rep spoke on David's behalf, about the level of feeling of the Cupar posties and their ballot for strike action.
David's lawyer summed-up succinctly and enlightened us all with his wit about the fact that 'belief' is just not enough, "he could believe the moon is made of cheese!". His final words were clearly heartfelt.
Another wait to find out what will happen next, and the judge acknowledged that.
